James O'Neal - 1878

Aug. 26, 1878 - Petitioner Loudisa O'Neal, widow of James O'Neal, against Thomas H. O'Neal, Samuel Reed [Reid in another place] & his wife Rose Ann, Dameron O'Neal & William O'Neal, the last two being under 21 and without guardian. Samuel Reid & his wife being of Beaufort County. Petitioner shows the court that James O'Neal died intestate in Hyde Co. in Feb. 1878 and that he was possessed of a tract of land on Mount Pleasant adjoining the lands of D.H. Pugh and others which contains about 50 acres. Also another tract on Mount Pleasant adjoining the lands of Joseph White and others containing 24 acres. Petitioner is desirous to have her dower allotted to her and to have a guardian, ad litem, appointed for Dameron & William O'Neal.

Oct. 22, 1878 - Thomas H. O'Neal states that he has a deed of conveyance from his father, James O'Neal, made in 1873 which was some time before Loudisia became the wife of James O'Neal. He states further that this deed given him includes the 24 acre tract and he objects to the court allotting any portion of the land to Loudicia O'Neal for her dower because he is the lawful owner.

NOTE: James E. O'Neal was born c1824 and died Feb. 14, 1878.  He was married 3 times--1st to Emeline Hawkins Taylor (1826-c1860) in 1849; 2nd to Mrs. Harriet Ellen Hawkins (1837-1870) circa 1861; and 3rd to Mrs. Susan Loudisa (Paine) O'Neal (1823-1904) on August 1, 1875.  The first marriage produced 6 children:
    1. Thomas Henry O'Neal (1850-1930) - married Mary Margaret "Mag" Francis
    2. Rosanna James O'Neal (1853-19__) - married Samuel H. Reed who died before 1900.  Rosanna lived in Washington, NC in 1880 & 1900.
    3. Emeline Hawkins O'Neal (1854-1854)
    4. James Immanuel O'Neal (1854-1854)
    5. George Eamon V. O'Neal (1857-1862)
    6. William Gilbert O'Neal (1858-aft. 1878)
James's 2nd marriage produced 3 children:
    1. Major L. O'Neal (1862-1872)
    2. Joseph Dameron O'Neal (1864-1915) 
    3. Cora Lee O'Neal (1866-1871)
