- To this amount set off to widow in part of her years provisions - $162.40
- A further amount paid over to the widow by the administrator for a balance of her years provision which was not on hand - $91.00

Court of Pleas and Quarter Sessions
State of North Carolina - Hyde CountyAugust Term 1841
To the Worshipful the Justices of said Court The petition of Thomas BALLANCE, assigne of Hilliard GIBBS and Nancy his wife, respectfully sheweth that sometime in or about Nov. 1840 (1839 marked thru) John NORTHERN died intestate in said County and that at November Term 1840 of the Court of please and Quarter Sesions for said County letters of Administration on his estate duly issued to Benjamin R. SAUNDERSON who took on himself the burden of administering the same. Your petitioners shew that said John NORTHERN died possessed of a large estate in money, ___________, goods and chattel, and the following slaves namely: BET, JACK, ANGELINE, BESS, HARRIET, SAM, JANE, VICEY? AIRE?, HETTY all of which come into the posesions of the said Administrator who has paid the debts of said intestate. Your petitioner show your worship that the next of kin of said intestate were his children, viz: Your petitioner Nancy, Solomon NORTHERN, Sarah NORTHERN, John NORTHERN a minor with Solomon NORTHERN as his guardian, and Zachary GIBBS grandson of said intestate and son of Elizabeth, late wife of Davis GIBBS and daughter of said intestate, who died before her said father. Said Zachary is a minor and said Solomon is his guardian. Your petitioners desire to have a settlement of said estate and that said Administrator may account before some person appointed by this Court with your petitioners and the other next of kin for his receipts and disbursements reporting what may be found due upon a settlement, and that the slaves now in his posesion may be divided among your petitioners and the other next of kin according to their respective rights. Your petitioners pray therefore that you would appoint three lawful freeholders to lay off and allot to your petitioners their share of said slaves in ___ty according to law and to make reports of their proceedings in the premises? under their hand and return at the next term of this court. Your petitioners further pray that you would appoint a guardian to said John S. NORTHERN to attend to and protect his interests in this suit. To that end and that said Administrator may accounts with your petitioners on his ________ with? and answer respecting the arrangements of said estate. And that said negroes may be divided. May it please your worship to issue writs of subpena commanding said Benjamin R. SAUNDERSON, Solomon NORTHERN, Sarah NORTHERN, John S. NORTHERN & Zachary GIBBS to appear at next term of this Court and answer as aforesaid and that you will grant to your petitioners such other and further relief as their case may require and to you may seem meet?. And your petitioners as in duty bound? will ever pray ye.
