I, Lula M. Midyette, of the County of Hyde, State of North Carolina, do hereby revoke all former wills made by me and do hereby make, publish and declare this my last will and testament in the manner and form as follows:

Item One - I direct my executor hereinafter named to pay all of my just debts, funeral expenses, costs of administration and to erect at my grave such monument as he may deem proper out of the first moneys coming into his hands belonging to my estate.

Item Two - I will and bequeath unto my daughter, Mary M. Swindell, in fee simple my ring, clothing, personal effects and in fact all of my personal property remaining after carrying out the provisions of item one of this my last will and testament.

Item Three - I will and devise all of my real estate and particularly my home lot which is described in a deed from S.J. Gibbs and wife to me dated August 19, 1915, which is recorded in the Office of the Register of Deeds of Hyde County, North Carolina, in Deed Book 41, page 587, to my son, J. Beamon Midyette, absolutely and in fee simple.  I am devising my home place to my son, J. Beamon Midyette, for the reason that he has spent considerable money in keeping the same in repair and has been the principle source of my income during the latter years of my life.

Item Four - I hereby constitute and appoint my son, J. Beamon Midyette, the executor of this my last will and testament, and I do hereby give and grant unto said executor full power and authority to sell any property or do any act which in his opinion is reasonably necessary for the proper administration of my estate.  In testimony whereof, I, Lula M. Midyette, have hereunto set my hand and seal, this the 22 day of October, 1956.

Signed, sealed, published and declared by the said Lula M. Midyette to be her last will and testament in the presence of us who at her request and in her presence and in the presence of each other do hereunto set our hands as witnesses.

[NOTE]  Lula Mae Satterthwaite, daughter of Thomas Mahue Satterthwaite & Mary Elizabeth Mason, was born Aug. 1, 1889 and died Sept. 13, 1960.  She married Riley Murray Midyette on April 7, 1912 and they had three children: 1) Leslie McCoy Midyette (1913-1951); 2) Jesse Beamon Midyette (1915-1974); and 3) Mary Mae Dill Midyette (1917-1995) who married Marion Jerome Swindell in 1945.
