In the name of God Amen. I Elizabeth Midyett of the Township of Swan Quarter in the County of Hyde and state of North Carolina, being of sound mind and memory and considering the uncertainty of this frail and transitory life do therefore make, ordain, publish and declare this to be my last Will and Testament. That is to say first after all my lawful and just debts are paid and discharged the residue of estate, real or personal I give and bequeath and dispose of as follows, to wit: I give and bequeath unto my daughter Sophia E. Bridgman my tract of land whereon I now live, it being twenty-five acres (more or less) in which I make, constitute and appoint my son Z.R. Midyett to be executor of this my last Will and Testament hereby revoking all former Wills by me made.

In witness whereof I have hereunto subscribed my name and affixed my seal this April 13th 1878.

A paper purporting to be the last Will and Testament of Elizabeth Midyett, deceased, is exhibited before me, the undersigned Clerk of Superior Court for said County, by John W. Jester and the due execution thereof by the said Elizabeth Midyett, by the oath and examination of R.W. Harris and M.W. Farrow the subscribing witnesses thereto, who being duly sworn, doth depose and say, and each for himself deposeth and saith, that he is a subscribing witness to the paper writing now shown him purporting to be the last Will and Testament of Elizabeth Midyett, that the said Elizabeth Midyett in the presence of this deponent subscribed her mark at the end of said paper writing, which is now shown as aforesaid, and which bears date of the 13th day of April 1878.
    And the deponent further saith that the said Elizabeth Midyett, the testator aforesaid, did at the time of making her mark as aforesaid, declare the said paper writing so subscribed by her and exhibited, to be her last Will and Testament; and this deponent did thereupon subscribe his name at the end of said Will as an attesting witness thereto, and at the request and in the presence of said testator.
    And this deponent further saith that at the time when the said testator made her mark to the said last Will as aforesaid, and at the time of the deponent's subscribing his name as an attesting witness thereto, the said Elizabeth Midyett was of sound mind and memory, of full age to execute a Will, and was not under and restraint to the knowledge, information or belief of this deponent, and further, these deponents saith not.

Severally sworn and subscribed this 12th day of August 1884 before me Jas. H. Wahab, Clerk Supr. Court.  Ordered that said Will with foregoing probate be recorded & filed.

[NOTE]  Elizabeth "Betsy" Jarvis, daughter of Jonathan & Lydia Jarvis, was born c1810 and died in May 1880.  She married John Midyett (died aft. 1880) before 1829 and they had at least 7 known children: 1) Zachariah Robert Russell Midyett, Pearline "Lina" Midyett, Albin B. Midyett, Elizabeth Midyett, John Oliver Midyett, Mary Ann Midyett, and Sophia E. Midgett who married Thomas G. Bridgman in 1872.
