Last Will and Testament of A.L. Midyette

I, Allen Lindsay Midyette, being of sound mind and body and realizing the uncertainties of life do hereby make, publish and declare this to be my last will and testament.

I do hereby will, give and bequeath unto my beloved wife, Gertrude W. Midyette, all of my personal property of whatsoever kind or nature of which I shall die seized and possessed or to which I shall be entitled at the time of my death, outright and absolutely, to dispose of as she sees fit, if she shall survive me.

I hereby will, give and devise unto my beloved wife, Gertrude W. Midyette, during the term of her natural life, all real property wheresoever situated of which I shall die seized and possessed or to which I shall be entitled at the time of my death.

I appoint my wife, Gertrude W. Midyette, as executor of my estate and request that in this capacity no bond be required of her.  All wills or codicils heretofore made by me are hereby revoked and declared null and void.

Codicil to Last Will and Testament of A.L. Midyette dated April 23, 1955
    Should my beloved wife, Gertrude W. Midyette, become in need of more money than has been provided for her due to sickness, inflation or other causes, she shall be permitted to sell any or all of any real property wheresoever situated which I may own or to which I may be entitled at the time of my death.  Signed this 24^th day July 1970.

[NOTE]  Allen Lindsay Midyette, Sr. was born in Fairfield, NC on Mar. 7, 1897 to Allen Burrus Midyette & Jane Lindsay "Jennie" Carter.  Allen married Gertrude Ward (1896-1991) on Sept. 18, 1920.  Allen passed away in Washington, Beaufort Co., NC on Feb. 7, 1976.
