Robert Jennett, Sr.
April 25, 1857 - Oct. Term 1857

In the Name of God Amen.

I, Robert Jennet Senior of the County of Hyde and State of North Carolina being of sound and disposing mind and memory, and being desirous of setting my worldly affairs, and directing here the estate with which it has pleased the almighty to bless me shall be disposed of after my decease, do make and publish this my last will and testament, hereby revoking and making null and void all other wills & testaments by me heretofore made.  As to my estate and all the property, Real, Personal, & Mixed of which I shall die seized and possessed, or to which I shall in any wise be entitled at my decease, I devise, bequeath and dispose in the manner following (VIZ)

I give and devise to my son Samuel G. Jennett the tract of land on which he now lives, lying on White plains on both sides of the public road, containing about two hundred and thirty acres to him his heirs and assigns forever.  I also give him the following negro slaves (viz) July, Sarah Ann, Joseph, Matilda, Cornelius, Lucy and Bryant, in consideration of which it is my will that said Samuel G. Jennett shall & I hereby direct him to pay to my three grand children Susan Ann, Mary Eliza, & Richard Howard jointly, the sum of four hundrid dollars in annual instalments of two hundred dollars each.

I give and devise to my Daughter Elizabeth Sparrow, wife of William  T. Sparrow, during her life, and after her death to her Children then living, absolutely and forever, that part of my home plantation which lies to the South & west of my Orchard ditch, adjoining the lands of David  S. Gibbs, beginning at Benners A. Eusties line, running in a strate line so as to intersect with said dich [ditch] at its uper tenninure? to include the lands I purchased of Benjamin B. Fulford and a part of that I purchased of Richard J.? Wynne containing about eighty acres.  I also loan to my daughter Elizabeth during her lifetime, the following negro slaves (viz) Harriet, Patsy, Annison?, Dick, Relly & Arrena and at her death I Give said salves, with their increase, to such child or children as she may leave her surviving, but if she should die leaving no children living at her death, then it is my will that said land & slaves shall go to my other heirs in the regular course of decent & distribution.  I also give to my Daughter Elizabeth, absolutely, one horse, two cows & Calves & three sows & piggs.

3d  I give to my three grand children Susan Ann Howard, Mary Eliza Howard and Richard Howard, Negro Slaves Mann, Fanny & Daniel and four hundred dollars to be paid them by Samuel G. Jennett in manner as heretofore directed.  I also give and devise to them my interest in the lands and Negros belonging to the estate of John Howard, which I purchased of the Trustee under the trust executed by their father Richard Howard to Josiah V. Blackwell and also of Ann Ballance.

4  I give and bequeath to my grand son Edward L. Blackwell, Negro Slaves named Stanly, Cilus, Louisa, Annis, Henry & Gustus.  I also give him the sum of five thousand dollars in good solvent? bonds or notes, to be paid to him by my executor herein after named, at as early a day after my decease as practicable.

5  I give and bequeath the balance of my negroes not heretofore named and bequeathed to my three sons Henry, Robert & Jones Jennett, to be equally divided among them in any manner they may think best and most satisfactory.

6  I give that portion of my home plantation not included in the devise to my Daughter Elizabeth and which lies on the north and east of the orchard ditch including the Wynne purchase to my two sons Robert & Jones, to be equally divided between them.  I also give them that tract which lies on the east end of the lake, adjoining the lands of Washington Gibbs & Benjamin B. Fulford known as the Henry Gibbs land containing about thirty acres.

7  It is my will that the entire wooded portion of my home lands embraced in the devise to my sons Robert & Jones & my daughter Elizabeth shall remain in common as a wood and timber privilege to the entire tract.

8  Having heretofore given to my son Henry Jennett a deed of Gift for the tract of land lying on South lake on which he now lives I hereby ratify and confirm said deed by devising the same to him, his heirs and assigns forever.  I also give him one bed and furnature.

I give to my sons Robert and Jones all of my stock of cattle, horses & hoggs excepting those given to my daughter Elizabeth Sparrow.

The residue of my property, real, personal & mixed, not specifically devised and bequeathed, I give to my executors in trust, first to pay all of my debts, and then to be equally divided between my sons, Robert & Jones, and my daughter Elizabeth Sparrow, and my three grand children Susan A. Howard, Mary E. Howard and Richard Howard, they taking one part jointly.   And I hereby constitute and appoint my two sons Robert Jennett & Jones Jennett my Executors of this my last will and testament.

In testimony whereof I the said Robert Jennett Sen. have hereunto set my hand & seal this the 25 day April 1857.

Signed sealed and published in the presence of us, who in the presence of each other, and at his request, have subscribed our names as witnesses hereto.

    A paper writing purporting to be the last will and testament of Robert Jennett Sen., deceased, is exhibited in open court for probate by Robert Jennett Jr. & Jones S. Jennett the executors therein named, and the due execution thereof by the said Robert Jennett Sen. is proved by the oath and examination of Henry S. Gibbs & Carney Gibbs, the subscribing witnesses thereto.  It is therefore considered by the court that said paper writing and every part thereof is the last will and testament of said Robert Jennett Sen. and the same is ordered to be recorded and filed.  And thereupon the said Robert Jennett Jr. & Jones S. Jennett, executors as aforesaid, duly qualified as such by taking the oath required by law.
