In the name of God amen I Foster Jarvis in the county of Currituck Being Sick and weak but of perfect mind and memory thanks be given to God therefore calling to mind the uncertainty and Instability of this Transitory Life and Knowing that it is appointed for all men once to die do make and ordain this my Last will and testament in manner and forme as follows. That is to say I Recommend my Soul into the Hands of almighty God that gave it nothing Doubting but at the General Resurrection to Receive the same again thro the mighty power of God my Body I Recommend to the Earth to be Decently Interred at the Discretion of the Execr. Hereafter named and as for my worldly Goods which almighty God of his Infinite mercy has Been Pleased to bestow upon me in this Life I Give and Bequeath in manner and form as follows.

Item. I Give and Bequeath unto my son Samuill Jarvis one Hundred acors of Land more or Less adjoyning to John Woodhouses (several words crossed through) Begining upon the worter next to Salyers, (inserted: "so runing as the line now goes") also I give one hundred acors of that land which Lyes between John Williams and Samuil Salyer to Have out of the Southward part Begining at the worter and so Runing Through to my Son Samuell Jarvis.

Item. I Give to my Son Jonathan Jarvis two (note: the word "two" appears to have been written over the word "one") Hundred acors of Land which Lyes betwen John Williams and that that I have already given to my son Samuill to him and his Heirs and if my son Jonathan Should Dye with out Lawfull are to fall to my Grand son Samuil Jarvis.

Item. I Give and Bequeath unto my son Martain Jarvis three Hundred and Sixty one acors of Land it being the Plantation whareon I now Live Runing South(wardly as Far as) an oak tree Standing near the worter side more or less and then Runing awestardly course the same as is betwean Here and Churches Land.

Item. I Give and Bequeath unto my son William Jarvis three Hundred and Sixty acors of Land more or Less it Being the Remainder of this Track that I have given already to my son Martain Lying Southwardly and as for the Remainder of my Estate to be Equally Divided betwean my son Foster and Jonathan and Elizabeth and Francis Jarvis after my Deceas.

Furthermore I ordain constitute and appoynt my son Martain Jarvis and William Jarvis my Hole and Sole Exers of this my last will & testament abjuring and disanulaing all wills by me maid heretofore Ratifying & Confirming this & no other to be my Last will & testament as Witness my Hand and Seal this 5 day of December 1750.

    January County Court 1750 Present His Majestys Justices &c. These may Certifie that Samuel Salyer Hillary White Michael ONeal appeared in open Court & Made oath on the Holy Evangelist that they were present & Saw Foster Jarvis Sign Seal Publish and Declare the within to be & Contain his last Will & Testament & that the said Foster Jarvis was then & at that Time of Sound & Disposing Memory & that they also Saw Henry Kinsey the other Subscribing Evidence Sign his Mark thereunto at the same time. There also appeared Martine Jarvis & William Jarvis Exors in Open Court and took the Exors Oath in Due form of Lawe.  Ordered that the Honble Nathl. Rice Esq. Secretary of the said province have Notice thereof that Letters Testamentary Issue thereon as the Law Directs.
