I, Mary E. Howard of Hyde County and State of North Carolina, do hereby make and declare this to be my last will and testament evoking all others by me heretofore made, to wit:

1st - I give and devise to my brother Richard Howard, my tract of land lying in Hyde County on Wysocking adjoining the lands of Tobbert Selby and David A. Gibbs, containing about forty acres to him & his heirs forever.

2d - I give to Richard Howard two hundred dollars out of the funds coming to me in the Settlement with my guardian, to hold in trust, for the benefit of Eliza Farrow daughter of Wilson T. Farrow, untill she comes of age or marries, and then to be paid over to her - but if she should die before she comes of age or marries then to his own use absolutely.

3d - I give to my esteemed friend Martha Jennett the sum of one hundred dollars to be paid her out of said fund.

4th - I give to my uncle Jones S. Jennett the sum of one hundred and fifty dollars to be paid in like manner out of said fund.

5th - I give to my brother Richard Howard all of the balance & residue of said fund, whatever it may be for his sole use & benefit.

Lastly I hereby appoint and constitute Jones S. Jennett my executor to carry into effect this my last will, with directions to pay over the several sums being bequeathed as soon after my death a practicable.

    A paper writing purporting to be the last will and testament of Mary E. Howard, deceased, is exhibited before me, the undersigned, Judge of Probate for said County.  Jones S. Jennett the executor therein named, and the due execution thereof by the said Mary E. Howard, by the oath and examination of N. Beckwith and L.J.P. Midyett the subscribing witnesses thereto, who being duly sworn, doth depose and say, and each for himself, deposeth and saith, that he is a subscribing witness to the paper writing now shown him purporting to be the last will and testament of Mary E. Howard.  That the said Mary E. Howard, in the presence of this witness subscribed her name at the end of said paper writing, which is now shown as aforesaid, and which bears date on the 15th day of May 1868.
    And the deponent further saith that the said Mary E. Howard the testator aforesaid, did at the time of subscribing her name as aforesaid, declare the said paper writing so subscribed by her, and exhibited, to be her last will and testament, and this deponent did thereupon subscribe his name at the end of said will as an attesting witness thereto and at the request, and in the presence of the said testator.  And this deponent further saith that at the said time when the said testator subscribed her name to the said last will as aforesaid, and at the time of the deponent's subscribing his name as an attesting witness thereto as aforesaid, the said Mary E. Howard was of sound mind and memory, of full age to execute a will, and was not under any restraint to the knowledge, information or belief of this deponent, and further these deponents say not.
    Severally sworn and subscribed this [blank] day of [blank] 1868.
