State of North Carolina
       Hyde County

Know all by these presents that I Zacheus Fortescue being in a sick bed but of good sound mind and memory do make this my last will & testament.  it is my first wish that my old negro woman Peggy should have a good & sufficient maintenance and that she shall have I give her two acres of land where my brother William R. Fortiscue should think proper to lay the said land off at on my Slades Creek Plantation adjoining the lands of Mackwell R. Fortescue and that my dear brother William R. Fortiscue should see that she is taken care of during her life.  Then it is my next wish that my dear brother William R. Fortescue should be my executor to my last will and testament to keep all my lands and negroes in common stock to rent & hire out untill all my debts is paid and that he should sell the perishable property at his own discretion.

I give to my dear brother Wm. R. Fortescue negro boy Dub for the maintenance of negro woman Peggy.

I now make this my last will & testament it being in the year of our Lord one thousand eight hundred & forty seven this December the thirtieth day in the presence of

    Then was the within & annexed will & testament of Zacheus Fortiscue, dec'd., exhibited in open court by William R. Fortescue the executor therein named and duly proved by the oaths of John L. Bell & John L. Martin the subscribing witnesses thereto who deposed that they attested the same in the presence of the Testator and at his request & that at the time of doing so he was of sound mind and memory ordered that the same be recorded.
