STATE OF NORTH CAROLINA
Hyde County

In the name of God, Amen.  I Albert Cartwright being at this time in comparative health, and of sound mind & Memory calling to mind the frailty & uncertainty of human life, and being desirous of settling my worldly affairs to make this my Last Will and Testament in the following manner to wit:

My will is that all my just debts and funeral charges shall by my executor hereinafter named be paid out of my estate as soon after my decease as shall by them be found convenient.

Item:  I give, devise and bequeath to my beloved wife Nancy M. Cartwright all my household and personal property of every kind to have and to use during her lifetime.

Item:  I give devise and bequeath to my dear son John R. Cartwright Twenty six & l/2 Acres of land situated in Fairfield Township in Hyde County adjoining the lands of Thomas Burrus heirs & A. J. Mann.

Item:  I have already given my grand daughter Anna L. Carawan Eighty Acres of land situated on Rose Bay and in Swan Quarter Township Hyde County for which I have given a deed, adjoining the lands of John Bridgeman & others.

Item:  I have also give to my daughter Nancy E. Neal by deed One Hundred & Twenty Acres of land also situated on Rose Bay in Swan Quarter Township Hyde County adjoining the lands of Henry Spencer & others.

Item:  I give, devise & bequeath to my grand children Mary M. Benston & Anna E. Benston my entire interest in the Jordan land situated in Fairfield Township of Hyde adjoining the lands of Columbus Simmons and others.

Item:  I give devise and bequeath to my daughter Eliza F. Bridgman and my daughter Martha E. M. Credle in common the land upon which I now live containing 90 acres situated on Rose Bay in Swan Quarter Township and in Hyde County adjoining the lands of G. M. Swindell & others.

Lastly, I do nominate and appoint my son John R. Cartwright to be the executor of this my Last Will and Testament.

In testimony whereof I the said Albert Cartwright have to this my Last Will and Testament subscribed my name and affixed my seal this 23rd day of November in the Year of our Lord 1885.

STATE OF NORTH CAROLINA}
HYDE COUNTY                            }              SS            IN THE SUPERIOR COURT

A paper purporting to be the Last Will and Testament of Albert Cartwright, deceased, is exhibited before me, the undersigned, Clerk of the Superior Court for said County, by Robert Cartwright the executor therein mentioned, and the due execution there of by the said Albert Cartwright is proved by the oath and examination of Geo. Credle and A. Berry the subscribing witnesses thereto; who, being duly sworn doth depose and say and each for himself deposeth and saith; that he is a subscribing witness to the paper writing now shown him purporting to be the Last Will and Testament of Albert Cartwright; that the said Albert Cartwright in the presence of this deponent subscribed his name at the end of said paper writing which is now shown as aforesaid, and which bears the date of the 23 day of November 1885.

And the deponent further saith, That the said Albert Cartwright the testator aforesaid did at the time of subscribing his name as aforesaid declare the said paper writing so subscribed by him and exhibited, to be his Last Will and Testament, and this deponent did thereupon subscribe his name at the end of said Will as an attesting witness thereto and at the request and in the presence of the said testator.  And this deponent further saith that at the said time when the said testator subscribed his name to the said Last Will as aforesaid and at the time of deponent’s subscribing his name as an attesting thereto as aforesaid the said Albert Cartwright was of sound mind and memory of full age to execute a will and was not under any restraint to the knowledge, information or belief of this deponent:  and further these deponents say not.

It is therefore considered and adjudged by the Court that the said paper writing and every part thereof is the Last Will and Testament of Albert Cartwright, deceased, and the same with the foregoing examination and certificate are ordered to be recorded and filed.
