Hezekiah F. Barnett
Feb. 9, 1863 - May Term 1866

In the name of God, Amen.  I Hezekiah F. Barnett of the County of Hyde and State of North Carolina being sick and weak in body but of sound and disposing mind and memory blessed be the Almighty God for it.  Calling to kind the uncertainty of this life and it being ordained once for all people to die I do make and ordain this instrument of writing to contain my Last Will and testament disannulling and revoking all other Wills and Testaments heretofore made by me either by word or writing and this only to be taken as my Last Will and Testament.  First, that is to say, I recommend my soul to Almighty God that gave it and my body to be decently buried in a Christian like manner buryed in a place where it may please my executors hereafter named as to what worldly estate it hath pleased God to bless and bestow on one far above my deserts I give and dispose in manner and form as follows--

First I give and bequeath unto my son Aaron Barnett twenty five acres of land known as the Jacob old place.  I also give him my riding horse one cow known by the name of the white face cow one blaze face mare one bed and furniture one chest one small trunk one chest my shaving box and tools and clock one old big wheel to him and his heirs forever.  I also give unto my son Napoleon H.F. Barnett twenty five acres of land joining A. Barnett on the East also one bay mare one red cow with a white face two sheep two hogs one bar and one sow one bed and furniture one red table one blue chest to him and his heirs forever.

I also give unto my son Hezekiah F. Barnett my house and land where I now live with all the improvements thereon to him and his heirs forever also one small mare one cow and calf called Hart two ewe sheep one spotted sow and pigs one bed and furniture one red chest all my carpenters tools one table one canoe to him and his heirs forever.

I also give unto my Daughter Angelico Barnett one black blaze face mare one bed and furniture one black cow and calf two sheep one table one linen wheel & cards one loom one pr. of gears one good sley and new big wheel also the red mares yearling to her and her heirs forever.

I also give to my son David W. Brady two small beds and furniture one mare yearling one buffalo cow and calf two sheep some hogs known as Davids hogs one chest I also give him forty dollars in cash to educate him.  I also give to him one old big mare if David W. Brady should die before he comes to the age of twenty one years the property to go back to my heirs.

I also give unto N.H.F. Barnett one mare yearling to him and his heirs forever.  I also leave my horse known by the name of Sealous to the use of the family.  I also leave my black horse and boats to be sold and the proceeds arising from said sale to be equally divided between my four children, viz--Aaron Barnett, N.H.F. Barnett, Angelico Barnett and H.F. Barnett to them and their heirs forever.  I also leave my stalyon horse to run at large for the use of my children forever.

I do also constitute make and appoint my son Aaron Barnett Executor to this my Last Will and Testament to settle this my estate according to law as witness my hand and seal this the 9th day of February in the Year of Our Lord One Thousand Eight Hundred and Sixty Three.

Hyde County SS - November Term 1866
    Then was the within and foregoing paper writing purporting to be the last Will & Testament of Hez. F. Barnett exhibited for probate in open Court by Aaron Barnett the executor therein named & the due execution thereof by the said Hez. F. Barnett is proved by the oath & examination of Joseph C. Jennett one of the subscribing witnesses thereto.  It is therefore considered by the Court that the said paper writing and every part thereof is the last Will & Testament of the said Hez. F. Barnett and the same is ordered to be recorded & filed.

Brady, Mary/Polly Ann
    17 Sep 1852: Warrant to apprehend Mary Ann Brady, a single woman now with a bastard child.  /s/ Joseph C. Jennette, J.P.
    17 Sep. 1852: Exam of Mary Ann Brady [signed by her mark] and she saith that she is now with child which is likely to be born a bastard and chargeable to the county and that Hezakiah F. Barnett of Cape Hatteras is the father.  /s/ Joseph C. Jennette, J.P.
    17 Sep. 1852: Warrant to apprehend Hezekiah F. Barnett, planter of Cape Hatteras; Hezekiah F. Barnett, planter of Cape Hatteras and Robert Robinson, planter of Cape Hatteras, to appear at Swanquarter at the Court of Pleas & Quarter Sessions on the 29 day of Nov. to answer the charge of bastardy.
    30 Nov. 1852: 100# Bastardy bond by Hezekiah F. Barnett, Caleb B. Stowe, and Benjamin T. Fulcher. Condition of bond is that Hezekiah F. Barnett is charged with having begotten a bastard child upon Polly Ann Brady, single woman.
