That Boliver McRae, late of Harnett County, N.C. died intestate about 1948; that he left no lineal descendants; that his wife, Mary Jane McRae is now deceased. II. That the heirs of Boliver McRae, deceased, are the parties to this action, being lineal descendants of the uncles and aunts of Bo1iver McRae, said uncles and aunts being David McRae, Christian McRae Black, Neill McRae, Isabella McRae, Neill Archibald Stewart, David Stewart, Flora Ann Stewart & John Stewart, Daniel McRae, Mary McRae; and that said descendants are the only heirs-at-1aw of Bo1iver McRae. III. That at his death, Bo1iver McRae was the owner of a tract of land situate, in Upper Little River Township, Harnett County, North Carolina, as follows: All the land which Bo1iver McRae died seized and possessed of, containing approximately 150 acres, more or less, which said land is referred to in a deed dated April 3D, 1948, recorded in book 310,' page 574, Harnett County Registry, and a deed dated March 12, 1973 recorded in book 588, page 124, Harnett County Registry. A metes and bounds description of the said land is not available at the filing of this petition, and a survey of the said land is necessary for an accurate determination of the boundaries of said land. IV. That the heirs at law of the said David McRae are jointly the owners of a one-tenth undivided interest in said lands; that the petitioners are advised and believe that the surviving heirs of David McRae and the interest of each of said heirs in the lands of Boliver McRae is as follows: A. That the heirs at law of the said Christian McRae Black are jointly the owners of a one-tenth undivided interest in said lands; that plaintiff is advised and believes that the said heirs of Christian McRae Black and the interest of each of said heirs in the lands of Boliver McRae is as follows: A. That the petitioners desire that the said lands be sold for division for that the interest of each of the co-tenants is such that an actual partition of the said lands would not be advisable or feasible and that a division cannot be made without injury to the joint tenants. That a commissioner should be appointed to sell the said lands for division and that the net proceeds from the said land, after the payment of the costs, including all legal fees and commissioners' fees should be distributed to the said tenants in common as their interest appears in this petition. That the court order a survey of the said property described herein for an accurate determination of the metes and bounds of the land in question, and that the Clerk of Court appoint a surveyor to make said survey and report his findings to this court.
