27 Oct. 1795       The Last Will and Testament of William Simmon N. Carolina - Franklin County

In the Name of God Amen  I William Simmons being Sick of body, but of perfect Sense & Memory, thanks be to God for it  I hereby make and Ordain this my last Will & Testament, & first & principally of all I leave my Soul to God that gave it me, & my Body to Christian burial at the Descretion of my Exectrs. nothing doubting but it will be raised at the last day by the mighty power of God and as for the worldly goods that God has been pleased to bestow on me I leave them in the folowing manner (To Wit)  First that all my Just debts be paid.

Item-I give & bequeath to my Daughter Mary Stallings & Moses Stallings her Husband Five Shillings to them & their Heirs for ever.
Item-I give & bequeath to my Son Richard Simmons Five Shillings to him & his heirs forever.
Item-I give & bequeath to my Daughter Ann Eley & William Eley her Husband one bay mare called Butler one Feather bed & Furniture, One Chest, Two pewter dishes, five pounds Currency to them & their Heirs for ever.
Item-I give & bequeath to my Daughter Agnes Ralls & James Ralls her Husband five Shillings to them &  their heirs for ever.
Item-I give & bequeath to my Son Henry Simmons a parcel of land Whereon he now lives Containing One Hundred acres be the Same More Or Less, bounded as follows (To Wit)  Beginning at a white Oak John Copes Corner thence North to a white Oak  in the Cypress Creek thence down  Said Creek to the mouth of the great branch, thence a direct line to the first Station to him & his heirs for ever.
Item-I give & bequeath to my Son Benjamin Simmons a parcel of land Containing one Hundred acres be the Same More Or Less, Bounded as follows
(To Wit)  Beginning on the Cypress Creek at the Mouth of the first Branch that is below the Spring branch where James Ralls formerly lived & thence up Said branch to the head thence a direct Course to Cross the Road at the foot (fork?) of the old mill path & to continue on to the long branch thence down sd Branch to Stallings line thence West to a corner Hickory thence North to a corner gum thence West to Sd creek thence up the Said Creek to the first Station, One feather bed & furniture, one Horse Colt One Cow & Calf to him & his heirs for ever.
Item-I give & bequeath to my Son William Simmons a plantation & parcel of
Land where James Ralls formerly lived containing One Hundred acres to be the Same More Or Less Bounded as follows (to Wit) Beginning at the Cypress Creek where my son Benjamin Simmons Began thence along his line to his Corner thence along his Other line to the long branch thence up said  branch to the mouth of the first Branch above the plantation thence up Said  branch to the head.  Thence a direct Course with the Stony Hill to the Spring branch thence down sd branch to the Creek thence down the Creek to the first Station, one feather bed and Furniture, one Cow & Calf To Him and  his heirs for ever.
Item-I give & bequeath the Plantation with the Remainder Part of my land, Houses & Orchards that has not before been mentioned to my Son John Simmons, one Cow & Calf one feather bed & furniture and as for the Remainder part of my Household goods & Chattles or any thing not before mentioned with the houses & plantation I leave to my well beloved wife Elizabeth Simmons & also two Negros named Nero & Lyd.   I leave them to her during her Widowhood & then the Plantation Houses & Orchards & Remainder part of my Land that is not give away to Return to my Son John Simmons To him & his heirs for ever.
I also leave Nero & Lyd the two negros to be equally Divided Between my three Sons, Benjamin, William & John Simmons & also the Remainder part of my household goods & chattles I leave to be equally Divided Between them at my Wife's Elizabeth Simmons decease or marriage and I do nominate and appoint Henry Simmons & Benjamin Simmons my two sons to be my __ Executors of this my last Will and Testament Disavowing all other Will or Wills by me heretofore made In Witness Whereof I have hereunto Set my hand & Seal this the Twenty Seventh day of October One Thousand Seven Hundred and Nintey Five.
