I Oscar S. Midgett of Rodanthe, Dare County and State of North Carolina, Being of sound Mind and Memory declare this to be my last will and testament.  I give, devise, and bequeath all my estate real and personal to my beloved wife Rebecca A. Midgett.  I further bequeath the United States Government to pay my Government Life Insurance to my beloved wife in one sum.

I nominate and appoint my said wife, Rebecca A. Midgett, to be the executor of this my last will and testament, made in witness whereof I have hereunto set my hand and seal the 10th day of July 1923.

Signed, sealed, published and declared as and for his last will and testament by the above named testator, in our presence who have at his request and in his presence, and in the presence of each other, signed our name as witnesses thereto.

    A paper writing purporting to be the last will & testament of Oscar S. Midgett deceased is exhibited before me the undersigned C.S.C of said County by  Rebecca A. Midgett the executrix therein named and the due execution thereof by said Rebecca A.. Midgett by the oath and examination of Fred O誰eal and Beulah O誰eal the subscribing witnesses thereto who being duly sworn doth depose and say, and each for himself deposeth and saith that he is a subscribing witness to the paper now shown him purporting to be the last will and testament of Oscar S. Midgett that the said Oscar S Midgett in the presence of the deponents subscribed his name at the end of said paper writing which is now shown as aforesaid and which bears date of July 10, 1923 and these deponents Fred O誰eal and Beulah O誰eal saith that the said Oscar S. Midgett the testator as aforesaid did at the time of subscribing his name as the foresaid declared the said paper writing so subscribed by him and exhibited to be his last will and testament and this deponent did thereupon subscribe their names at the end of said will as attesting witnesses thereto and at the request and in the presence of said testator and these deponents further saith that at the same time when the said testator subscribed his name to the said last will as aforesaid and at the time of the deponents subscribed their names as attesting witnesses thereto as the foresaid Oscar S. Midgett was of sound mind and memory of full age to execute a will and was not under any restraint to the knowledge or belief of these deponents, and further these deponents say not.
