In the name of God Amen.  I, Jesse Etheridge of Currituck County, State of North Carolina, being of sound mind and memory but considering the uncertainty of this frail life, do make publish and declare this my last will and testament hereby revoking all former wills by me at any time heretofore made.  And as to my worldly estate and all the property real and personal or mixed of which I shall die seized and possessed or to which I shall be entitled at the time of my decease I devise bequeath and depose thereof in the manner following to wit:

First: My will is that my just debts and burial expenses shall by my executrix hereinafter named be paid out of my estate as soon after my decease as shall by her be found convenient.

Item 1.  I give devise and bequeath to my beloved wife Margaret B. Etheridge my boat Frank Pigott, Canoe Rough & Ready, and all the boats or canoes whereof I may die seized or possessed, together with all my nets or seines, and also three ox carts and three yokes of oxen, absolutely.

Item 2.  I give devise and bequeath to my nephew Jesse Benjamin Etheridge two (2) mares & two (2) colts together with their increase that may be on hand at my death.

Item 3.  I give devise and bequeath to my brothers John B. & Adam D. Etheridge five ($5) Dollars each also a like sum to my sister Sallie Montique and same amount to the heirs of my deceased sister Margaret Dough.

Item 4.  I leave my dwelling house and land and its appurtenances situated on Bodies Island County and State aforesaid and also the residue of my estate real, personal, and mixed to my beloved wife for and during the time she shall remain my widow and at her death or if she should remarry again then I give, devise, & bequeath the same mentioned property to my nephew Jesse Benjamin Etheridge and his heirs.  Should my said nephew die during my lifetime living issue surviving heirs then it is my will that said issue should receive the property hereby conveyed to his heirs share and share alike.

Item 5.  I hereby nominate constitute and appoint my beloved wife Margaret B. Etheridge Executrix to this my last will and testament, considering to her care and protection my said nephew Jesse Benjamin Etheridge in testimony whereof I the said Jessie Etheridge do hereunto set my hand & Seal this 20th day of December one thousand eight hundred and sixty.

Signed Sealed Published and declared by the said Jessie Etheridge as and for his last will and Testament, in the presence of us who at his request and in his presence and in the presence of each other, have subscribed our names as witness thereto day and date above mentioned.

    A paper writing purporting to be the Last Will and Testament of Jessie Etheridge Deceased is exhibited before me the undersigned Clerk of Court of said County by Jessie B. Etheridge and the due execution thereof by said Jessie Etheridge by the oath and examination of J.T. Etheridge & B.B. Dough the Subscribing witnesses thereto who being duly sworn, doth depose and say and each for himself deposeth and saith that he is a  subscribing witness to the paper writing now shown here purporting to be the last will & testament of Jessie Etheridge that the said Jessie Etheridge in the presence of these deponents subscribed his name at the end of the said paper writing which is now shown as aforesaid and which bears date of the 20th day of December 1860.
    And the deponents further saith that the said Jessie Etheridge the testator aforesaid did at the time of Subscribing his name as aforesaid declare the said paper writing so subscribed by him and exhibited to be his Last Will and Testament and this deponent did thereupon subscribe his name at the end of said will as an attesting witness thereto and at the request and in the presence of the said Testator. And this deponent further saith that at the said time when the said testator subscribed his name to the said last will as aforesaid and at the time of deponents subscribing his name as an attesting witness thereto as aforesaid, the said Jesse Etheridge was of sound mind and memory of full age to execute a Will and was not under any restraint to the knowledge & information or belief of this deponents, and further these deponents say not
