I, Thomas Baum of the aforesaid County and State being of sound mind and memory, but considering the uncertainty of my earthly existence, do make and declare this my last Will and Testament:

First:   I give unto my son Robert M. Baum all the land, and the home that I now own and live at, also all the personal property that I may own at my death with the following provisions;

That should I during my life time fail to pay my daughter Sallie Tillett, the sum of three hundred dollars then my son, above named, shall pay to said Sallie Tillett, as her interest in my estate at my death the said sum of three hundred dollars, but should I pay to said Sallie Tillett the said sum of three hundred dollars then my son Robert Baum shall not be under any obligations to her whatsoever and she shall, have no interest whatsoever in the aforesaid mentioned premises, and as to my daughters Carrie L Whitson and Minnie Montague, they have made, and were provided for as follows.

I gave to my daughter Carrie L. Whitson the sum of three hundred dollars and my daughter Minnie Montague has expressed herself as being willing that my son Robert M. Baum should have the home and land without obligation to her whatsoever so I accordingly make this my last Will and Testament;

 Second:  I hereby constitute and appoint Robert M. Baum, without bond, my lawful executor to all intent and purpose, to execute this my last will and testament according to the true intent and meaning of the same, hereby  revoking and declaring Void all other Wills made by me.

In Witness whereof I, the said Thomas Baum do hereunto set my hand and seal this the 7th day of May 1929.

Signed, sealed, published and declared by the said Thomas Baum to be his last Will and Testament in the presence of each other, do subscribe our names as witnesses thereto.

    A paper writing purporting to be the last Will and Testament of Thomas Baum, deceased, is exhibited before me, the undersigned, Clerk of the Superior Court for said county, by Robert M. Baum, the executor therein mentioned, and the due execution thereof  by the said Thomas Baum by the oath and examination of S.A. Griffin and Melvin R. Daniels, two of the subscribing witness thereto, who being duly sworn, doth depose and say, and each for himself deposeth and saith, that he is a subscribing witness to the paper writing now shown him, purporting to be the last Will and Testament of Thomas Baum; that the said Thomas Baum, in the presence of this deponent, subscribed his name at the end of said paper writing, which is now shown as aforesaid, and which bears date of the 7th day of May 1929.
    And This Deponent Further Saith, That the said Thomas Baum the testator aforesaid, did, at the time of subscribing his name as aforesaid, declare the said paper writing so subscribed by him and exhibited to be his last Will and Testament, and this deponent did thereupon subscribe his name at the end of said Will, as an attesting witness thereto, and at the request and in the presence of said testator. And this deponent further saith, that at the same time when the said testator subscribed his name to the said last Will as aforesaid, and at the time of the deponents subscribing his name as attesting witnesses thereto, as aforesaid, the said Thomas Baum was of sound mind, and memory, of full age to execute a Will, and was not under any restraints, to the knowledge, information, or belief of this deponent:  And further these deponents say not.

Severally sworn and  subscribed, this 19th day of November 1930. before me

    It is therefore considered and adjudged by the Court that the said paper writing and every part thereof is the last Will and Testament of Thomas Baum, deceased.  Let said Will together with the probate, be recorded and filed.  This 19th day of November 1930.

NOTE:  Thomas Baum, son of Samuel and Sarah (Etheridge) Baum, was born in Wanchese, NC on Nov. 29, 1863 and died on Nov. 5, 1930 in Dare County.  He is buried in the Baum Cemetery in Wanchese.  Thomas married Lucy Jane Midyett in Hyde Co., NC on Dec. 24, 1890 and they had the following known children:
    1) Carrie Lee Baum (1892-1964); married Solomon Beasley Whitson
    2) Minnie Willis Baum (1894-1985); married 1st Robert H Hingerty, married 2nd Augustus Montague
    3) Sallie Ann Baum (1897-1986); married Stephen Beasley Tillett
    4) Lillie M. Baum (1899-1905)
    5) Clarence T. Baum (1902-1903)
    6) Robert Mullen Baum (1903-1974); married Gertrude Elizabeth Midgett
