I, Charles L. Austin of Hatteras Dare County, State of North Carolina being of sound mind and memory, do make, publish, and declare this to be my last will and testament: to wit:

First:  All my just debts and funeral expenses shall be first duly paid.

Second:  I give, devise, and bequeath all the rest residue and remainder of my estate both real and personal to my beloved wife, Martha A. Austin, to have and to hold, to her my said wife and at her death to my youngest son, Barney R. Austin, And all my money on hand and insurance to be divided with Barney R. Austin and all the other heirs to a single cent.

Third:  I nominate and appoint my said wife Martha A. Austin to be the executor of this my last will and testament hereby revoking all former wills by me made.

In witness whereof I have hereunto set my hand and seal, this 13th day of February. A.D. 1924.

Signed, sealed, published and declared as and for his last will and testament by the above named testator in our presence who have at his request and in his presence and in the presence of each other, signed our names as witnesses thereto.

I, C.L. Austin have given to my children land and cash as follows:
    I give to my son R.G. Austin two acres of land.
    I give to my son A.M. Austin two acres of land.
    I give to my son I.B. Austin two acres of land.
    I give to my son J.D. Austin $50.00 in cash.
    I give to my daughter Virginia Austin $50.00 in cash.
    I give to my daughter Laura Byrd one acre of land.
    I give to my daughter Elizar Stowe $50.00 in cash.

    A paper writing purporting to be the Last will and testament of Charles L. Austin, deceased, is exhibited before me, the undersigned, Clerk of the Superior Court for said county, by Martha A. Austin the executrix therein mentioned, and the due execution thereof by the said Charles L. Austin by the oath and examination of R.F. Gaskins and D.M. Gray, the subscribing witness thereto, who being duly sworn, doth depose and say, and each for himself deposeth and saith, that he is a subscribing witness to the paper writing now shown him, purporting to be the last Will and Testament of Charles L. Austin; that the said Charles L. Austin, in the presence of this deponent, subscribed his name at the end of said paper writing, which is now shown as aforesaid, and which bears date of the 13th day of February 1924. And this Deponent Further Saith, That the said Charles L. Austin the testator aforesaid, did at the time of subscribing his name as aforesaid declare the said paper writing so subscribed by him and exhibited to be his last Will and Testament, and this deponent did thereupon subscribe his name at the end of said Will, as an attesting witness thereto, and at the request, and in the presence of said testator.  And this deponent further saith, that at the same time when the said testator subscribed his name to the said last Will as aforesaid, and at the time of the deponents subscribing his name as attesting witness thereto, as aforesaid, the said Charles L. Austin was of sound mind and memory, of full age to execute a Will, and was not under any restraints, to the knowledge, information, or belief of this deponent:  And further these deponents say not. 

Severally sworn and subscribed, this 26th day of March, 1931, before me.

     It is therefore considered and adjudged by the Court that the said paper writing and every part thereof is the last Will and Testament of Charles L. Austin deceased.  Let said Will, together with the probate, be recorded and filed.  This 26th day of March 1931.

NOTE: Charles Lamb Austin, son of Moses Ransom Austin and Fannie Fulcher, was born at Hatteras (Hyde Co.) on Jan. 26, 1861 and died Nov. 21, 1930 in Dare Co.  He married Martha Ann Peele (1863-1933) at Hatteras on July 2, 1881 and to them the following children were born:
    1. Russell Gibbs Austin (1882-1938) married Neva Willis
    2. Rebecca B. Austin (1884-1906) married Urias O'Neal Gaskins
    3. Eliza Jane Austin (1886-1926) married Allen Burrus Stowe
    4. Augustus Moore Austin (1888-1965) married Virginia Comfort Oden
    5. Ivy Benjamin Austin (1890-1945) married Ida Spencer Peele
    6. Virginia Dare Austin (1893-1970) married Harry Lee Austin
    7. Joshua Dailey Austin (1895-1946) married Elizabeth "Lizzie" Willis
    8. Laura Atwood Austin (1898-1986) married Jesse B. Byrd
    9. Barney Ransom Austin (1902-1934) married Irene L. Barnett
