Mary Ann West
Sept. 19, 1890 - Dec. 19, 1890

I Mary Ann WEST of Moyock Currituck County North Carolina make this my last will, revoking all former wills.  I give, devise bequeath my estate and property, real and personal as follows, that is to say.  I give to my daughter Fanny WEST one bed, pillows and covering, one cow and calf, One sewing machine, One large chest.

I give to my son Manly WEST a certain tract of land in Moyock township Currituck County North Carolina and described as follows, being a part of the Tully DOZIER land and bounded by the Cynthia GARRETT land on the North by the land of Samuel DOZIER on the East and by the Willoughby WEST land on the South and West, containing twenty four acres more or less.  All the rest of my property I wish to have divided equally among the following named persons.  My sons Caleb WEST and Willoughby WEST and my Daughters Anthea (West) COTTER and Fanny WEST.

I appoint my son Manly WEST of Moyock Currituck County North Carolina, Farmer, executor of this my will.  In witness whereof I have signed and sealed and published and declared this instrument as my will at Moyock Currituck County North Carolina on this nineteenth day of September in the year of our Lord eighteen hundred and ninety.

The said Mary Ann WEST at said Moyock Currituck County North Carolina on said nineteenth day of September eighteen hundred and ninety signed and sealed this instrument and published and declared the same as and for her last will.  And we at her request and in her presence and in the presence of each other have hereunto written our names as subscribing witnesses.

  PROBATE OF WILL

State of North Carolina}    SS.  In the Superior Court Before H.B. ANSELL, Clerk
     Currituck County    }    In Re Estate of Mary Ann WEST, deceased
    A paper writing purporting to be the last will and testament of Mary Ann WEST, dec'd., is exhibited in open court for probate by Manly WEST, Executor therein named; and the due execution thereof by the said Mary Ann WEST, dec'd., is duly proven by the oath and examination of T.D. WALKER and J.D. BAKER subscribing witnesses thereto; and it is further shown to the satisfaction of the court by said witnesses that the said Mary Ann West was, at the time of making said will, of sound mind and memory, of full age to execute a will and was not under any restraint to the knowledge, information or belief.
    It is therefore considered, adjudged and decreed that said proof is sufficient and according to law and that said paper writing is and contains the last Will and Testament of Mary Ann WEST, dec'd.  And on motion it is ordered that said Will be admitted to probate and recorded in the Book of Wills of Currituck County and as such filed as provided by law in the office of the Clerk of Superior Court of said county.
    It is further ordered that said Manly WEST be allowed to qualify as executor as provided by law and enter upon the discharge of the duties imposed by said trust.  Dated this the 19th day of December 1890

Thereupon Manly WEST took the oath prescribed by law and letters testamentary with will annexed was granted him this 19th day of December 1890.

EXECUTOR'S OATH

State of North Carolina}    SS.  In the Superior Court
    Currituck County     }
    I, Manly WEST do solemnly swear or (affirm) that I believe this writing to be and contain the last Will and Testament of Mary Ann WEST deceased; and that I will well and truly execute the same by first paying her debts and then her legacies, as far as the said estate shall extend, or the law will charge me; and that I will well and faithfully execute the office of an executor agreeable to the trust and confidence reposed in me, and according to law, so help me God.

APPLICATION FOR LETTERS TESTAMENTARY

State of North Carolina}    In the Matter of the Will of [blank]
     Currituck County    }    Before H.B. ANSELL, Clerk Superior Court
    Manly WEST, being duly sworn, doth say: That Mary Ann WEST, late of said County, is dead, having first made and published her last Will and Testament; and that Manly WEST is the executor named therein.
    Further, that the property of said Mary Ann WEST consisting of land & chattel property and the land is worth about $380, the chattels is worth about $500 so far as can be ascertained at the date of this application; and that Manly WEST is entitled to the land as by will & the chattel estate & Caleb WEST Willoughby WEST Anthea COTTER Fanny WEST are the parties entitled under said will to the said property.
