Zachariah Waterfield
July 22, 1865 - Nov. Term 1865

In the name of God Amen.  I Zachariah WATERFIELD of the state of North Carolina & Currituck County being of sound and disposing mind do make and publish this my last will and testament in manner and form as follows viz

Item 1st  I lead all of my property both real and personal to my wife Elizabeth WATERFIELD during her widowhood to use at her disposal and after the expiration of said widowhood I give the said property to my Children and grand Children in the following manner.

Item 2nd  I give and bequeath to my son Wm A. WATERFIELD Two Hundred dollars to him and his heirs forever.

Item 3rd  I give and bequeath to my grand Children Wm WATERFIELD Lydia A. WATERFIELD and Nolly WATERFIELD the sum of Two Hundred dollars to be equally divided between them and each one to receive their portion as they arrive to the age of twenty one years.

Item 4th  I give and bequeath to my grand Children Josephine WATERFIELD and Devany? WATERFIELD the sum of Two Hundred dollars to be equally divided between them and each one to receive their portion when they arrive at the age of twenty One years.

Item 5th  I give and bequeath to my daughter Emily E. WATERFIELD the little farm where Saml COOPER now resides on to her and her heirs forever.

Item 6th  I give and bequeath to my son Calvin C. WATERFIELD my North end tract of land joining the lands of Jesse WHITE to him and his heirs forever.

Item 7th  I give and bequeath to my son Lewis N. WATERFIELD my home tract of land by his paying to his sister Frances V. WATERFIELD Two Hundred and fifty dollars when she arrives at the age of twenty one years to him and his heirs forever.

Item 8th  I give and bequeath to my daughter Frances V. WATERFIELD Two Hundred and fifty dollars to be paid by my son Lewis N. WATERFIELD when my daughter Frances V. WATERFIELD arrives at the age of twenty One years.

Item 9th  I give and bequeath to my daughter Emily E. WATERFIELD and son Lewis N. WATERFIELD the woodland on the east side of my swamp tract of land Emily to have the woodland on the North side of the road runing from the Jesse C. WATERFIELD farm to the cleared land of the swamp tract of land and Lewis N. WATERFIELD to have the south part to them and theor heirs forever.

Item 10th  I leave my swamp tract of land to be sold on the premises and to be sold into two divisions the said tract to be divided in the center runing east and west then turning and runing north to the glade then turning and runing westwardly keeping the center of the glade to the marsh.

Lastly I nominate Constitute and appoint my wife Elizabeth WATERFIELD Executrix to this my last will and testament revoking all former wills by me made in witness whereof I have hereunto set my hand and Caused my seal to be affixed this July 22nd 1865.

    Currituck County     }    November Term 1865
    The within paper writing purporting to be the last Will & Testament of Zachariah WATERFIELD is exhibited for probate in open Court by Elizabeth WATERFIELD the Executrix therein named, and the due execution thereof by the said Zachariah WATERFIELD is proved by the oath & examination of E.W. JONES one of the subscribing witnesses thereto and it is further proved by the said Witness that John J. WATERFIELD the other subscribing witness to said Will is dead and that he is well acquainted with the hand writing of Said J.J. WATERFIELD having often seen him write, and that his name subscribed to Said Will is in his own hand writing, and the witness further proved that he Saw said J.J. WATERFIELD subscribe Said will as a witness, that he subscribed it in his presence and in the presence and at the request of the Testator.
    It is therefore considered by the court that the said paper writing and every part thereof is the last Will and Testament of Zachariah WATERFIELD, decd, sufficient in law to pass both real & personal estate, and the same is ordered to be recorded and filed.  And thereupon the Said Elizabeth WATERFIELD the Executrix therein named duly qualified as such by taking the oath & Giving the bond required by law.
