Ruben Waterfield
May 1, 1908 - Sept. 14, 1908

In the name of God Amen.

I Rubin WATERFIELD of Knotts Island Currituck County State of North Carolina do make publish and ordain this my last will and testament in manner and form following - that is to say --

Item 1 I give and bequeath to my wife Georganna all of my real estate owned by me for and during her natural life and at her death I give to my six children as discribed herein.

Item 2 To my son Leva N. WATERFIELD I give on the south side commencing at a post adjoinding the land of Timothy BOWDEN running north to a post thence westernly to the Indian Creek.

Item 3 To my Daughter Lydia A. NEWMAN I give the next piece adjoinding Timothy BOWDEN running north to a post thence westernly to the Indian Creek.

Item 4 To my son Nolly WATERFIELD I give the next piece adjoinding the land to Timothy BOWDEN running north to a post thence westernly to Indian Creek.

Item 5 To my Daughter Levenia CAPPS I give the next piece adjoinding the land of Alonzo ANSELL running north to a post thence westernly to a post thence southernly to a post thence easternly to Alonzo ANSELL land.

Item 6 To Georgie May GARRETT my Daughter I give the next piece commencing at a post at the fence running easternly to a post thence northerly to a post thence westernly to a post at the fence thence as the fence runs to a post.  The land on the west of this gift I give to my two Daughters Levinia CAPPS and Georgie May GARRETT commencing at the fence thence westernly to the Great marsh Levinia CAPPS I give the north side and Georgie May GARRETT I give the south side to be equally devided.  I also give to my two Daughters Levinia CAPPS and Georgie May GARRETT all of my land on the west side of the Indian Creek.

Item 7 To my son Walter WATERFIELD I give the next piece commencing at a post adjoinding the land of Alonzo ANSELL running north to a post at the lane thence westernly to the Great marsh.

I nominate and appoint my wife Georganna my executrix to This my last will and testament for which I have set my hand and seal This 1 day of May 1908.

     Currituck County    }
    A paper writing purporting to be the last will and testament of Ruben WATERFIELD, deceased, is exhibited before me, the undersigned, Clerk of the Superior Court for said County, by Georganna WATERFIELD, the executrix therein mentioned; and the due execution thereof by the said Ruben WATERFIELD is proven by the oath and examination of J.B. JONES and R.L. MILLER the subscribing witnesses thereto: who, being duly sworn, doth depose and each for himself deposeth and saith that he is a subscribing witness to the paper writing now shown him purporting to be the last will and testament of Ruben WATERFIELD and that the said Ruben WATERFIELD in the presence of this deponent subscribed his name at the end of said paper writing and which bears date of 1st day of May 1908.  And the deponent further saith, that the said Ruben WATERFIELD the testator aforesaid, did, at the time of subscribing his name as aforesaid, declare the said paper-writing so subscribed by him and exhibited, to be his last will and testament and this deponent did thereupon subscribe his name at the end of said Will as an attesting witness thereto, and at the request and in the presence of the said testator.  And this deponent further saith, that at the said time when the said testator subscribed his name to the said last will as aforesaid and at the time of deponent's subscribing his name as an attesting witness thereto, as aforesaid, the said Ruben WATERFIELD was of sound mind and memory, of full age to execute a will and was not under any restraint to the knowledge, information or belief of said deponent.  And further these deponents say not.

APPLICATION FOR LETTERS TESTAMENTARY

Currituck County)    In the Superior Court
In the Matter of the Administration of the Estate of Ruben WATERFIELD

      Before E.W. ANSELL, C.S.C.
    Georganna WATERFIELD, being sworn, doth say That Ruben WATERFIELD, late of said county, is dead, without leaving any Will and Testament [I don't' understand this last statement since Ruben Waterfield obviously left a will. kms]; and that Georganna WATERFIELD is the proper person entitled to Letters of Administration on the estate of the said Rubin WATERFIELD.
    Further, that the value of said estate, so far as can be ascertained at the date of this application, is about $75.00 and Georganna WATERFIELD, Knotts Island, N.C., Leva N. WATERFIELD, Knotts Island, N.C., Lydia A. NEWMAN, Knotts Island, N.C., Nolly WATERFIELD (minor), Knotts Island, N.C., Levenia CAPPS, Knotts Island, N.C., Georgie May GARRETT, Moyock, N.C., Walter WATERFIELD (minor), Knotts Island, N.C. are entitled as heirs and distributees thereof.
