In the name of God, Amen. I Daniel TOLSON of the State of North Carolina and County of Currituck, being very sick and weak in body, but of perfect mind and memory, thanks be given unto God, calling unto mind the mortality of my body, and knowing that it is appointed for all men once to die, do make and ordain this my Last and Testament, that is to say, principally and first of all I give and recommend my soul into the hand of Almighty God that gave it, and my body I recommend to the earth to be buried in a decent christian burial, at the discretion of my executors nothing doubting but at the general resurrection I shall receive the same again by the mighty power of God. And as touching such worldy estate wherewith it hath pleased God to bless me in this life I give, devise and dispose of the same in the following manner and form.

First: I give and bequeath to my beloved Wife Mary TOLSON one riding horse, one saddle and bridle, and one cow and cow yearling, also I give unto my said Wife one half of the house and land whereon I now live (during her widowhood) and the other half I give unto my beloved Son Valentine TOLSON. Also I give unto my Daughter Charlotte FULCHER one wheel, and one ewe sheep, also I give unto my Grand Son Jabes MIDYETT fifty acres of land in the Savanner, joining Reuben BURROUGHs line. Also I give unto my Grand Son Benjamin TOLSON when he arrives at the age of twenty one years, one piece of land where Solomon MIDYETT now lives; also I give unto my Son Valentine TOLSON one boat and materials, and two guns, and one half of the nets and the other half to my Wife Mary TOLSON, and all my other property in doors and out doors I give unto my Son Valentine TOLSON. Also make Institute and ordain William WADE and my Son Valentine TOLSON sole executors of this my Last Will and Testament and I do hereby utterly disallow, revoke and disannul all and every other former testaments wills legacies, bequests and executors by me in any wise before named, willed and bequeathed ratifying and confirming this and no other to be my Last Will and Testament. In witness whereof I have hereunto set my hand and seal this fifteenth day of February one thousand eight hundred and nineteen.
