I, Thomas J. TILLETT of Currituck County, N.C. being of Sound mind and memory, do publish and declare this to be my last will and testament, to wit; all my just debts and funeral expences shall be paid.

Second, I request that my benefits in the Surfmans Mutual Benefit Association, be paid to my Daughter Jane E. TILLETT, for her to dispose of as she may see fit, to have and to hold and I further request that my Daughter Jane E. TILLETT shall act as administrator or administrix, and that my son Luther R. TILLETT assist her, bouth without bond, to this will and shall have power to collect all notes, and Insurance policies that I may hold and her or his receipt shall be acknowledged as legal and final, my policy in the life Insurance as with other property if any to be equally divided, as they seem fit, and I bequeath my piano to my Daughter Zora, my househole good not mentioned is to be divided as they all my children see fit.

In witness where of I have hereunto set my hand and seal this 18th day of December A.D. 1911.

PROBATE OF WILL

      Currituck County      }
   
A paper purporting to be the last Will and Testament of T.J. TILLETT deceased, is exhibited before me, the undersigned, Clerk of the Superior Court for said County, by JANE E. TILLETT, one of the devisees or legatees therein mentioned, and the due execution thereof by the said T.J. TILLETT is duly proven by the oath and examination of N.B. ETHERIDGE and H.C. SMITH, two of the subscribing witnesses thereto; who being duly sworn, doth depose and say, and each for himself deposeth and saith, that he is a subscribing witness to the paper-writing now shown him, purporting to be the last Will and Testament of T.J. TILLETT that the said T.J. TILLETT in the presence of this deponent subscribed his name at the end of said paper-writing, which is now shown as aforesaid, and which bears date of the 18th day of December 1911.
    And the deponent further saith, That the said T.J. TILLETT the testator aforesaid, did at the time of subscribing his name as aforesaid declare the said paper-writing so subscribed by him and exhibited to be his last Will and Testament, and this deponent did thereupon subscribe his name at the end of said Will, as an attesting witness thereto, and at the request and in the presence of said testator. And this deponent further saith, that at the same time when the said testator subscribed his name to the said last Will as aforesaid, and at the time of the deponent’s subscribing his name as an attesting witness thereto, as aforesaid, the said T.J. TILLETT was of sound mind and memory, of full age to execute a Will, and was not under any restraint, to the knowledge, information or belief of this deponent: And further these deponents say not.

It is therefore considered and adjudged by the Court that the said paper-writing and every part thereof is the last Will and Testament of T.J. TILLETT deceased. Let the said Will, together with the probate, be recorded and filed.  This 26th day of September 1913.

APPLICATION FOR LETTERS TESTAMENTARY

Currituck County:  In the Superior Court Before E.W. ANSELLL - In the Matter of the Will of T.J. TILLETT, deceased
   
Jane E. TILLETT being duly sworn, doth say: That T.J. TILLETT, late of said County, is dead, having first made and published his last Will and Testament: and that said Jane E. TILLETT is one of the devisee or legatee named therein, there being no executor named therein.
     Further, that the property of the said T.J. TILLETT consisting of Insurance, steamboat stock, note, Bank account, & household & kitchen furniture is worth about $1500.00, so far as can be ascertained at the date of this application; and that Mrs. V.H. KNIGHT Deals, N.C., Luther R. TILLETT, Zamborarga, P.I, W.N. Tillett, Hickory, Va., Zora TILLETT, Stewarts Draft, Va., Paul D. TILLETT, minor, Norfolk, Va., Oswald J. TILLETT, minor Raleigh, N.C. Jane E. TILLETT, Hickory, Va. Are the parties entitled under said will to the said property.
