Levi Stewart
July 15, 1752 - Jan. Court 1753

In the Name Of God Amen I Levi STEWART of the County of Curretuck in the province Of North Carrolinia Being Of Sound & perfect Memory But Sick And weake of Bodye do Make this My Last Will & Testament In Maner following Viz ---

I recomend My Sole to the all mighty god who gave it Liveing in Shore & Cartain hopes Of the Reshurection of the Dead Through merrits of My Blessed Savoure & Redeamar Jesus Christ.

Imprimis I give & Bequeath Unto My Son John STEWART the plantation & all the Land Belonging to it that I Now Dwell on and his heirs Lawfully Begotton for Ever But if he the sd John STEWART Should have No Such Heire then the said plantation & land My Desire is Should Returne To My Son Levi STEWART & his heirs for Ever.

Item I give and Bequeath Unto My Son John STEWART fifty Acres of Swampish Land Joyning to A place Called Broad Ridge adjoyning to phillip NORTHEN & John BENETs Line which said Land is part of pattent granted To Levi STEWART The farther of the sd John STEWART the 13th day of Novembr & in the yeare 1751 and was Surveayed By Mr CLATON To him the Sd John STEWART & his heirs for Ever.  Allso I Leave further More one hundred & Thirty five Acres of the Same Swampish pattend Land as above Mentiond to Be Sold By My Executrix Or ___irs?.

Item I give and Bequeath Unto My Son Levi STEWART one Negroe Boy Namd Jubeler to him & his hirs & one young Maire Called blase & her Increse & Two young Cows & Calves To him & his heirs.

Item I give & Bequeath Unto my Beloved Wife Ann STEWART one negroe garle Named Dye & her Increase To My Wifes own Dispossial as She Thinks Fitt--& further More My Desire is that My Just Debts be paid out of My other Estate & what doth Remain of My Estate To Be Eaqueally Devided Betwen My Beloved Wife & Two Sons afore mentioned & Lastly I Leave My Beloved Wife Ann STEWART My whole & Sole Exectrx of this My Las Will & Testament and in Testamoney Heriof I set my hand & fixd my Seale this fifteenth day of July 1752.

Present His Majesties Justices
    These may Certifie that Joseph STEWARD and Willis MILLER two of the Subscribing Evidences to the Within Will appeared in open Court & made Oath on the Holy Evangelist that they weare present and saw Levey STEWARD Sign Seal Publish and Declare the within writing to be and contain his Last Will and Testament and that the Said Levey STEWARD was then and at that time of Sound & Disposing Memmory and that they also See John BENIT the other Subscribing Evidence Sign His Name thereto at the Same time.  Then also appeared Ann STEWARD  Executrix in open Court and took the Executors Oath in due form of Law.  Ordered that the Honble John RICE Esqr Secretary of this province have Notice thereof that Letters Testamentory Issue thereon as the Law directs.
