I Mitchell SIMMONS of the County of Currituck in the State of N. Carolina do this Second day of August in the year of our Lord one Thousand eight hundred and Twenty three make publish and declare This instrument of writing to be my last will and Testament in manner and form as follows Viz.

Item. I give and bequeath to my son Hillory SIMMONS The Tract of Land that I bought of Thomas YOUNGHUSBAND also that piece of swamp that I bought (of) Samuel FEREBEE and one negro man named Bob and one negro girl named Juda and one old negro woman Phillis at my wifes intermarriage or death one feather bed and furniture and one negro called Polle and one cow & calf and one Sow and pigs four Eves and Lambs Two guns and all my carpenters and Blacksmiths tools to him and his heirs forever.

Item. I give and bequeath to my daughter Nancy FEREBEE the Tract of land whereon I now live also fifty acres of Swamp joining Jeremiah LANDs on one Side & Hillory SIMMONS on the other also one negro girl Sally & her increase and one negro Boy Ben one feather bed & furniture & one cow and Calf to her & her heirs forever.

Item. I give and bequeath to my daughter Elizabeth SIMMONS one half of the remainder of my Swamp land also one negro Man named Frank & one negro woman named Chloe and one feather bed and furniture and one cow and calf to her and her heirs forever.

Item. I give and bequeath to my daughter Lydia SIMMONS all the remainder of my swamp land joining her Sister Elizabeth SIMMONS being the balance of all my swamp land also one negro boy named Bill & a negro named Betsey & one feather bed and furniture and one cow and calf to her and her heirs forever.

Item. I give and bequeath to my wife Rebeca SIMMONS one negro man named James and one negro girl named Suzen & Two feather beds and furniture and one cow and calf to her and her heirs forever.

I lend the use of the plantation whereon I now live and negro woman Phillis & all my perishable property after paying my just debts to my wife Rebecca SIMMONS during her widow hood and at her intermarriage to be equally divided between her and my four children.

Item. It is my will for my negro woman Nancy and her children to be kept on the plantation for the use of the family till my youngest child is of age and then she and her increase to be equally divided between my two youngest daughters Elizabeth and Lydia SIMMONS and to be sold for a division but pay _____ (?) &c. to them and their heirs forever.

I appoint Samuel FEREBEE JUNr & Hillory SIMMONS executors to this my last will and testament in witness whereof I have hereunto set my hand and seal the day and date above.
