Knowing that I am mortal and must die and as God has before me, with some of the good things of this world which I wish to divide among my children, I do affix this my last will in the name of the heavenly father Amen.

I lend to my wife the plantation I now live on to wit the land I bought of the TAYLOR heirs, the land I bought of John DOWDY also the land I bought of Jasper JARVIS and the land I bought of Thomas DOWDY. Also my BARNARD plantation my son Jordan is to live on it--and pay my wife the one third of the corn he raises also. I lend to her all of my farming utensils and all of my home stock of cattle and hogs and sheep and my household and kitchen furniture during her lifetime or widowhood.

I give to my wife my horse bill and Rockaway harness and all of the poultry to her and her heirs.

I give to my son Jordan after the death or marriage of my wife the one half of the plantation that he now lives on called the BARNARD land to him and his heirs forever, he is to have the part the house stands on, it is to be divided East and West.

After the death or marriage of my wife I give to my two grandchildren Thomas POYNER and Elizabeth Medorah POYNER the other half of the plantation my son Jordon POYNER lives on it is known as the BARNARD land to be equally divided between them and their heirs forever.

I give to my daughter Martha Ann POYNER after the death or marriage of my wife Seventy Acres of land to be laid off adjoining of the land I bought with Mr. J. E. BROWN & wife and the land that Betsey DOWDY lives on in the deep swamp the South-line to ours Square with Mr. BROWN's line to her and her heirs forever.

After the death--the death--or marriage of my wife I give to my daughter Sarah E. POYNER the land I bought of Thos. DOWDY just as it stands under fence, also fifty acres of land to be laid off on the north side of the land I now live on to be laid off square with the land and line of Daniel C. LINDSEY to her & her heirs forever.

I give to my daughter Sarah E. POYNER all of the oyster shells I bought of Thos. B. JARVIS & wife. I have a right from Wm. JARVIS & wife.

I give to my daughter Martha Ann POYNER all of the oyster shells I bought of James E. BROWN & wife as it is staked off and as it is specified in the right that said BROWN & wife gave to me at the same time that Jarvis & wife gave theirs.

I leave my swamp on both sides of the Chesapeake & Albemarle Canal the swamp is between the Bridge and North River its boundaries may be ascertained by reference to deed from Thomas POYNER to myself and a right from the State to myself to be sold to pay my debts. Also my fishery and all the swamp belonging to said fishery its boundaries may be ascertained by reference to right from the State to myself also fifty acres at the Narrows of North River its boundaries to be ascertained to a patent from the State to me to be sold for to pay my debts the terms of sale of Swamp & Fishery and fifty-acres at the Narrows of N. River is left with my Executor.

I leave to my daughter Jane POYNER the piece or parcel of land I had of Mr. J. E. BROWN & wife Lovey known in a swap then being the land set apart to them in the division of Willoughby DOWDY's land to her and her heirs forever and fifty dollars to be raised out of my chattel property after the death or marriage of my wife.

After the death--or marriage of my wife my Executor is to sell all of my property--not given away and divide it between my children that is to say Susan, Polly, Thomas, Jordan, Martha Ann, Sarah, Jane, and Enoch POYNER.

I give my sons Jordan and Enoch POYNER my islands of marsh in Currituck Sound that is to say my Pilentary Island & little Burres Island and the five Islands I took up lying on the North-east and South-west and west of big Burress Island to them and their heirs forever.

I give to my son Jordan POYNER my canoe Robert Scott to him and his heirs forever.

I give to Enoch POYNER both of my sciffs to him and his heirs forever.

I give to Enoch and Jordan POYNER my Seine (?) and Seine (?) (next word is illegible, appears to be either vofre, perhaps rifle).

I give to my son Enoch POYNER the horse I bought of Edward MIDGETT & saddle.

I give to my two daughters Martha Ann POYNER & Sarah E. POYNER my buggy to them & their heirs.

I give to my wife my Rockaway & all my carts.

I bind my two sons Jordan & Enoch POYNER to pay all my above named children Ten dollars apiece that is to say Jordan each of them ten dollars and Enoch pay them ten dollars and they are to have one year to pay it in.

I give to my son Enoch POYNER two hundred cart loads of oyster shells to be got off the land I had of Mr. J. E. BROWN & wife. The shells to be gotten off adjoining of the Branch & not in the Old ground also give to him Enoch POYNER all of the Oyster Shells on the land I bought of James E. BROWN & wife Mary A. BEASLY I mean in the land as well as on the land to him & his heirs forever.

I give to my sons Jordon & Enoch POYNER the land I bought of J. E. BROWN & wife Mary Ann BEASLY as a privilege to the water and they are to grant to Martha Ann POYNER, Sarah E. POYNER, Thomas POYNER, and Elizabeth Medorah POYNER, Alberty GRIGGS, William GRIGGS, and Alice GRIGGS privilege to the water by help keeping it in repair.

After the death or marriage of my wife I give to my son Enoch POYNER all of the land where my dwelling house stands lying in between the land I have given to Martha A. POYNER and Sarah E. POYNER.

I give him all of my Swamp on Long Point and Stocks there to him and his heirs.

I give to him all of the rest of the Swamp adjoining of my high land that I patented for and he the said Enoch POYNER is to grant to Martha Ann POYNER and Sarah E. POYNER a stock privilege in said swamp that is to say that their cattle & hogs is to enjoy the Benefit of the range to them and their heirs forever.

I give to Alberty GRIGGS, William GRIGGS, Lozet GRIGGS, children of my daughter Polly GRIGGS the land I bought of Sampson MURRELL the boundary _____ may be known by reference to deed from Sampson MURRELL to my self to them & their heirs forever.

I give unto my three Grand children D. W. LINDSEY, Virginia LINDSEY, and Susan LINDSEY all of my Bank Land except twenty acres of Land Banks adjoining the Sand Beach or land formerly belonging to Samuel COOPER that he bought of Willougby DOWDY and is now owned by Josephus BAUM that twenty acres I give to Enoch & Jordan POYNER & their heirs forever.

I bind my son Jordan POYNER to Pay to Daniel W. LINDSEY, Virginia LINDSEY and Susan LINDSEY two hundred dollars to be equally divided between them and the Said Jordan POYNER is to have two years to pay the two hundred dollars in.

I Bind my son Enoch POYNER to pay unto Daniel W. LINDSEY, Virginia LINDSEY and Susan LINDSEY the children of Susan M. LINDSEY my Daughter to be equally divided between them and he the said Enoch POYNER is to have two years to pay the Said two hundred dollars in.

In the hands of a good God I give my Soul and body and the Souls of my wife and children and grandchildren and last of all I leave my son Jordan POYNER my executor and for him to give to the Court Such Security as the Court may require. Signed with my own hand
