I James POYNER of the County of Currituck and in the Province of North Carolina being very weak and low but of a perfect disposing mind and memory Thanks be given to Almighty God for it, do constitute ordain and make this my Last Will and Testament Disanulling all other former wills heretofore made.

Imprimis: I lend to my loveing Wife Mary POYNER the plantation and land whereon I now live untell my two Sons Robert and James POYNER arrives at the full age of twenty one and if she should continue single with what personal estate I have within doors and without to maintain and support my two Sons on but if my wife should marry before my two Sons come at age, then the before loaned estate as afs. (lands excepted) to be sold and the monies ariseing to be put at interest for my two Sons untell they come at age and be then equeally divided between them, and my two Sons Robert and James POYNER to be taken by my exec. put and bound to a trade.

Impremise: I give and bequeath the land and plantation I live on between my two Sons Robert and James POYNER to be equeally divided between them as followeth, from the run at Richardson MORSEs a straight cours to the land my Father Joseph POYNER deceased in his lifetime sold to Amos ETHEREDGE I give the said land to them and their heirs forever.

Item: The land I bought of my Mother Anne POYNER executrix of my Fathers, which was left by him to be sold.  I desire to be sold by my executors to discharge my lawfull debts.

Item: The right in negroes left my wife by her Father Benjamin COX I loan to my Loveing Wife during widowhood and after her intermariage, I give the said negroes to my two Sons to be equeally divided between them, to them and therr heirs forever.

I do appoint my Brother Joseph POYNER and Wife Mary POYNER executor and executrix of this my Last Will and Testament in witness whereof I have hereunto set my hand and affixed my seal the 16th day of November in the Fifteenth year of our reign 1775.
