James Nickolls
July 13, 1742 - Oct. Court 1742

In the Name of God Amen I James NICKOLLS of ye County of Curretuck & in Province of North Carlina being Sick of bodey but of Sound and perfect mind and memory thanks be to almighty God for it I Doe make & ordain and Constitute this my Last will and Testament in maner and form following  I give and Bequeath my Sole in to ye hands of Allmighty God whoe gave it me and my Body I Commit unto ye Earth to be Deasentely Buried att the Deaseresion of my Exr hereafter named.

Itm  I Give and bequeath to my Eldest Daughter Sarah NICKOLLS one Shilling Harding? money.

Itm  I Give and Beaqueath unto my Eldest Son James NICKOLLS one hundard & thirty five acres of Land being ye manard plantation I now Live on to him & ye heirs of his bodey Lawfully begoten for Ever.

Itm  I Give & Bequeath unto my Son Calib NICKOLLS the plantation where Simon NEWCRAFT? now Lives & all ye Land belonging to it Excepting thirty acres Lying att ye South Eand which is Called ye woolfpitt Ridge.

Itm  I Give & Bequeath unto my Son Willis NICKOLLS the Land & plantation over ye River Called Dunkins being one hundard & fifty acrs more or Less to him and ye heirs of his body Lawfully Begotten for Ever.

Itm  I Give & bequeath into my Daughter Frankey NICKOLLS thirty acers of Land being ye South End of the tract of Land which I gave to my Son Calib which was before Excepted to her & ye heirs of her bodey lawfully begoten for Ever.

Itm  I Give & bequeath all ye Rest & Residue of my personel Estate to be Equelly Devided amonkst my four youngest Children here after named James NICKOLLS Calib NICKOLLS and Willis NICKOLLS and Frankey NICKOLLS - Turn over-----

Itm  My Will and Desire is that all ye perrishable part of My Estate Shall be Sold att publick Saile for porke & ye porke Sold for Cash and kept for my Children tell they Com or attain to age to be Equelly Devided.

Itm  My Will & Desire is that my Children be foot free from ye Exercuotr att ye full age of Eight teen years oald and Likewise have their porshtions allsoe butt not allow to Deall or fool them away with out haveing ye Consent or advise of Executors in bargaining.

and Lastly my Will and Desire is that my well beloved frind John ETHERIDGE be full & whole Executtor of this my last will and Testament Revoking and Disanulling all oather wills here to fore mad by me Ratifying and Declearing this to be my last will & testament In Witness where of I have hereunt_ Sett my hand and affixed my Seale this 13 Day of July Ann Dom 1742.

 Currotuck County   County afore Said on Tuesday The Six Day of October 1742

Present His Majestys Justices
    These may Certifie That James BUTT and William ETHEREDGE Two of the Subscribening Evidences to the with in Will Came into  open Court and maid oaths on The holy Evangelist that they ware present and Saw James NICHOLIS Sign Seal publish & Declare the within to be and Contain his Last will & Testament and that they also Saw Darkes THOMAS the other Subscribeing Evidence Sign her Name Thereto att the Same Time.  Then Also appeared John ETHRIDGE Executor to the with in will and took The oath Appointed by Law for the Qualifications of Executors.  Ordered that the Honorable Nathaniel RICE Secretary have Notice thereof that Letters Testamentory May Issue.  Dated att the Clerks office This Eighteen Day of October anno D 1742
