present His Majesties Justices

The Last Will and Testament of Joseph MIDYETT was exhibited and proved by the oath of Thomas MIDYETT in due form of law the executors being duly qualified. Ordered to be recorded as follows.

In the name of God Amen the 24 day of January 1771 I Joseph MIDYETT of Chickenecomock Banks in the County of Currituck being very sick and weak of body but being in perfect mind and memory Thanks be to the Almighty God for it and calling to mind the mortallity of my body that it is appointed men once to die I do therefore make my Last Will and Testament in writing therefore and first of all I give and recommend my soul in to the hands of the Almighty God that gave it and for my body I commend unto the earth to be buried in the christian like manner at the discretion of my executors nothing doubting but at the general resurrection I shall receive the same. First of my desire is that all my lawfull debts be paid and as touching of my worldly estate give as in manner and form following.

Item: I give and bequeath unto my two Sons Richard and Christopher MIDYETT this piece of land whereon I now dwell to equally divid betwixt them the N. end to Richard and the south end to Christopher MIDYETT only excepting my Wife lifetime in it. To them and their heirs forever.

Item: I give and bequeath unto my beloved Wife Elizabeth Margery MIDYETT one negroe wench called Isbell to her and her heirs forever. Likewise the furniture and one Mare.

Item: I give and bequeath unto my beloved Son Christopher MIDYETT one negroe boy called Peter to him and his heirs forever.

Item: I give and bequeath unto my Loving Son Richard MIDYETT one negroe garl called Nell him and his heirs forever.

Item: I give and bequeath unto my beloved Daughter Christain MIDYETT one negroe garl called Bess to her and her heirs forever.

Item: I give and bequeath unto my Son Mathew MIDYETTs Daughter Margery MIDYETT one negroe called Joash to her and her heirs forever.

Item: After my Wifes third of my movables is taken out the remainder to be equally divided among all my children Joseph MIDYETT JUN. John MIDYETT, Matthew MIDYETT, Richard MIDYETT, Christopher MIDYETT and Christain MIDYETT I do hereby appoint my well beloved Wife Elizabeth Margery and my youngest Sons Richard MIDYETT and Christopher MIDYETT to be my whole and sole executors and do hereby acknowledge this to be my Last Will and Testament and do make void and disannull all other whomesoever they shall appoint as witness my hand and seal.
