    Currituck County

       I John MATHIAS being of sound disposing mind and memory do make publish and declare this to be my last will and testament to wit and as follows:

   Item 1st It is my wish and desire that all my debts and burial expences shall be paid out of my personal estate.

   Item 2nd I lend to my daughter Adelia CATON during her natural life the following piece of land described as follows beginning at a post in L.M. BELLs line running a south westwardly course by Caleb B. MATHIAS east gate post to an old ditch thence along the old ditch to a marked pine tree on the east side of the branch thence along a line of marked trees across the branch to J.W. BAXTERs line near a black gum thence northwardly along said line to the corner then a north east course along said BAXTERs line to the beech tree then north to Buckskin Road thence eastwardly along said road to the corner in BELLs line near the dwelling house then along said BELLs line to the beginning.  At the death of my daughter Adelia CATON I give and bequeath the above described land that I lend to her during her natural life to her child or children should she leave any begotten of her body to them & their heirs & assigns forever. If she does not leave any child or children I give and bequeath the above described land to my two grand children J.B. MATHIAS and Mary Elizabeth MATHIAS the children of my son Burnell MATHIAS Dec’d to them and their heirs and assigns forever.

   Item 3 I give and bequeath to my son Caleb B. MATHIAS all the remaining portion of my land to him his heirs and assigns forever.

   Item 4 I nominate and appoint and my son Caleb B. MATHIAS my executor without bond to this my last will and testament.  Witness my hand and seal this the 13 day of Nov. 1872.

 Currituck County}    In Probate Court
   A paper writing purporting to be the last will and testament of John MATHIAS Dec’d is exhibited in this Court for Probate by C.B. MATHIAS the executor therein named and the execution thereof by the said John MATHIAS is proved by the oath and examination of L.M. BELL and (blank) the subscribing witnesses thereto.  It is therefore adjudged and decreed that the said paper writing and every part thereof is the last will and testament of the said John MATHIAS and the same is ordered to be recorded and filed and thereupon the said C.B. MATHIAS the executor as aforesaid came forward & qualified as such by taking the usual oath.
