Hosea B. Mason of Norfolk Co., Va.

Last Will and Testament of Hosea B. MASON.  In the name of God, Amen.  I Hosea B, MASON of Norfolk County in the state of Virginia, in the fifty second year of my life, being of sound mind and disposing memory, do on this 22nd day of October, in the year 1895, publish and declare the following as and for my last will and testament.

Item I.  All my property both real and personal wheresoever the same may be situated, and whether the same be now mine or shall accrue to me hereafter, I hereby will and bequeath to my beloved wife Mary for her life or during such time as she shall remain my widow..  It is my will that she shall use the same in accordance with her best judgment for the benefit of herself and my children, and for this purpose she is hereby invested with power to alien or dispose of any such estate whether real or personal and reinvest or use the proceeds at her discretion.  And in no case shall the purchaser or purchasers of such estate or any part thereof be required to see to the application of the purchase money therefor.

Item II.  At the death of my said wife, I will and bequeathe my said property to my children or the survivor or survivors of them, share and share alike.  And in case my wife marry again then I will one third of such estate to my said wife, and the remaining two-thirds to my children as above.

Item III.  I hereby appoint my son Bruce executor of this my last will and testament, and it is my will that neither my said executor nor my wife as life tenant of said estate shall be required to give any bond or security for the faithful discharge of their respective duties as such.

In testimony of the foregoing I have hereunto set my hand and seal the day and year first above written.

Signed, sealed and acknowledged in our presence as and for the last will and testament of Hosea B. MASON, he signing in our presence, we in his at his request and each signing in the presence of each other, the 22nd day of October in the year A.D. 1895.

     At the County Court of Norfolk County held on the 22nd day of November 1895.  The last will and testament of Hosea B. MASON, late of Norfolk County, deceased, was produced on Court, proved by the oaths of H.A.J. SMITS and H.H. RUMBLE, the subscribing witnesses thereto, and ordered to be recorded.  And on motion of Bruce MASON, the executor therein named, who made oath thereto, and entered into and acknowledged a bond in the penalty of one thousand dollars, (without security, agreeable to the request of the testator) conditioned according to law, which bond is ordered to be recorded, certificate is granted him for obtaining probate of said will in due form.

    I, Alvah H. MARTIN, Clerk of the County Court for the County aforesaid, in the State of Virginia, do certify that the foregoing is a true copy of the will of Hosea B, MASON and of the probate admitting the same to record in the Clerk's Office of Norfolk County Court, as the same appears on file and record in my office.
    Witness my had and the seal of said Court affixed this the 22nd day of June, 1901.

County if Norfolk}    To wit:
    I, William N. PORTLOCK, Judge of the County Court for the County aforesaid, in the State of Virginia, do certify that Alvah H. MARTIN whose name is signed to the above certificate was at that time Clerk of the County Court for the County of Norfolk, and the signature thereto is genuine and that his said attestation is in due form and by the proper officer.
    Given under my had as Judge of the County Court for the said County this the 22nd day of June, 1901.

County if Norfolk}    To wit:
    I, Alvah H. MARTIN, Clerk of the County Court for the County aforesaid, in the State of Virginia, do certify that William N. PORTLOCK whose name is signed to the above certificate was at that time Judge of the County Court of Norfolk County, and that his signature thereto is genuine and that full faith and credit are due to his official acts as such.
    Given under my hand and with the seal of said Court hereto attached this 22nd day of June, 1901.

WILL--PROBATE OF, FROM ANOTHER STATE

State of North Carolina}    In the Superior Court
     Currituck County    }
    It appearing to the satisfaction of the court from the exemplification of the record herein after mentioned, that the last will and testament of Hosea B. MASON deceased, a citizen of Norfolk county and State of Virginia has been duly proved and allowed in the proper court of probate of said county sand state, according to the laws of said State, it is therefore ordered and adjudged that the exemplification of said will and of its probate in the proper court of the said county of Norfolk and State of Virginia which has been produced and exhibited here duly certified and authenticated, be allowed, filed and recorded in this court.  This 28th day of June 1901.
