In the name of god amen I David LINSEY of the County of Currituck and provence of North Carolina this seventeenth Day of august one thousand seven hundred and forty nine Do make and Declare this my Last Will and testament Revoking all other and former Wills in manner and form as following. first of all I commit my soul into the hands of almighty god, and my body to be buried at the Discretion of Executor hearafter named and for my Real and personal Estate I give and Dispose thereof in manner and form following (Viz)

I give and bequeath unto my Dear and well beloved wife Ann LINSEY all my moveable estate

Item. I give and Bequeath to my Beloved wife my house and plantation whereon I now Live and all the other Lands Belonging to me during her natural Life except a peace of Land from the gare pond to the point field that I give and Bequiath to my dear mother Sarah LINSEY During her Life only allowing a cart Road for my wife and after the Decease of my sd. wife and mother I will and bequeath my house and all my Land to fall to my brother Benjamin LINSEY and Lastly I do nominate and apoint my wife Ann LINSEY to be my Whole and sole Executor of this my Last will and testament Revoking and Disanuling all other former Wills and testaments in witness whereof I have hearunto Set my hand and Seal the Day and year above writen

Present his Majestys Justices &c.
    These May Certifie that Henery WOODHOUSE one of the Subcribing Evidences to the within Will apeared in Open Court & made Oath on the Holy Evangelists of Almighty God that he was present & Saw David LINSEY Sign Seal Publish & Declare the within to be & Contain his last Will & Testament & that the said David LINSEY was then & at that Time of Sound & Disposing Memory and that he also Saw Solomon SMITH & Meanus SMITH the Other Subscribing Evidences Sign their Names thereunto at the same time. Then also appeared Anne LINSEY Executrix in Open Court and took the Executors Oath in due form of Law Ordered that the Honble. Nath. RICE Secratary of the said Province have Notice thereof that Letters Testamentory Issue thereon as the Law Directs.
