Thomas Legitt
April 10, 1749 - July Court 1749

In the name of god amen.  I Thomas LEGITT of Corotuck County in north Carolina being sick and weak but In perfect sence and memory blessed be god for it I therfore make this my Last will and testament In maner and form following that is to say first and principally I recommend my soul to the Hands of the almighty god that gave it Hoping that by the meritts of my blessed saviour Jesus Christ to receive forgiveness for all the sins that ever I Have Commited in this wicked world --secondly my body to be buried in such Christian maner by my executor Hereafter nominated shall think fitt----

Item - I give and bequeath unto my wife Elisabeth my young negro fellow named Jacob to Her and Her Heirs for ever.  I give unto my wife my two Horses---

Item - I give unto daughter Elisabeth LEGITT my negro woman Hanah and Her Increas to Her and Her Heirs for ever.  I give unto my daughter also one young negro girl Called dye to Her and Her Heirs forever.  I give also unto my daughter one negro boy named Cipio to Her and Her Heirs for ever --- I also give unto my daughter Elisabeth [to dim to read] in Cash. ---

Item - I give unto my Cousin James LEGITT son of Alexander LEGITT my negro boy named will but In Case He should decease without Lawful Issue then to retern to my daughter Elisabeth. ---

Item - I give all my personal estate to be equally divided between my wife and my daughter and I doe also nominate and apoint my wife Elisabeth LEGITT whole executrix to this my Last will and testament.  In wittness whereof I have sett my hand and seal this tenth day of april one thousand seven hundred fourty nine

Present His Majestys Justices
    These may Certifie that Elias CORNISH & Robert SIMMONS Two of the Subscribing Evidences to the within will appeared in open Court & made Oath on the Holy Evangelists that they were present and Saw Thomas LEGETT Sign Seal Publish and Declare the within to be & Contain his Last will and Testament and that the said Thomas LEGETT was then & at that Time of Sound and Disposing Memory, and that they also saw Moses CAPPS the Other Subscribing Witness Sign his Name thereunto at the same Time.  Then also Appeared Elizabeth LEGETT Executrix in open Court and Took the Exors Oath in due form of Law.  Ordered that the Honble Nathl RICE Esqr Secretary of said province have Notice thereof that Letters Testamentory Issue theron as the Law Directs.
