Thomas Jarred

I, Thomas JARRED of the County and State aforesaid being very feeble in body but of good mind and disposing memory, do make this instrument my last will and testament, revoking all others.

My will and desire is that my executor hereinafter named, shall pay out of my estate all of my just debts and funeral expenses.

First.  I give and bequeath unto my grand daughter, Minnie Maud DOXEY all that may be left of my property after the settlement of my estate consisting of notes moneys or any other species of property under the following conditions to wit:  I hereby appoint Alma B. MIDGETT my sole executor to this my will and also appoint him trustee, to hold all of the property after the expenses of my estate is settled, for my said grand daughter Minnie Maud DOXEY in such a way as he may think best and proper for her interest and benefit, that he may from time to time pay out any amount of funds that he may have in his hand for her, for schooling and education or for any other cause for her benefit before she arrives at the age of twenty one years and in case she should live till she arrives at full age then in that case he shall pay over to her the whole amount or whatever may remain in his hands, to her & her heirs forever.

Second. But in case that my said grand daughter Minnie Maud DOXEY should die before she arrives at the age of twenty one years and that she has children lawfully begotten of her body then in that case the remains of the property left to her in 1st item shall go to them; but in case she dies without any children as aforesaid before she arrives of age, then said property so held for her shall be equally divided between my nearest of kin and that of my deceased wife's nearest of kin. Now let it be expressly understood that my said executor, Alma B. MIDGETT, also he being my appointed trustee for my grandchild as aforesaid, shall have the whole control of my estate, and out of the remains that may be in his hands after settlement of my estate, that said trustee shall so control the balance according to his best judgment so as to promote the interest and welfare of my said grand daughter especially in procuring for her an education and trade suitable to her sex.

In testimony whereof I Thomas JARRED have hereunto set my hand and seal on this the 18th day of November 1890.

PROBATE OF A WILL

State of North Carolina}    In the Superior Court
    Currituck County     }
    A paper writing purporting to be the last will and testament of Thomas JARRED, deceased, is exhibited before me, the undersigned, Clerk of the Superior Court for said County, by A.B. MIDGETT the executor therein mentioned, and the due execution thereof by the said Thomas JARRED is proved by the oath and examination of B.S. WALKER and Benjamin HOSKINS the subscribing witnesses thereto, who, being duly sworn, doth depose and say, and each for himself deposeth and saith that he is a subscribing witness to the paper writing now shown him purporting to be the last will and testament of Thomas JARRED; that the said Thomas JARRED  in the presence of this deponent, subscribed his name at the end of said paper writing, now shown as aforesaid, and which bears day of the 18th day of November 1890.
     And the deponent further saith, that the said Thomas JARRED the testator aforesaid, did, at the time of subscribing his name as aforesaid, declare the said paper writing so subscribed by him and exhibited, to be his last will and testament, and this deponent did thereupon subscribe his name at the end of said will as an attesting witness thereto, and at the request and in the presence of said testator.  And this deponent further saith, that at the said time when the said testator subscribed his name to the said last will as aforesaid, and at the time of deponent's subscribing his name as an attesting witness thereto, as aforesaid, the said Thomas JARRED was of sound mind and memory, of full age to execute a will, and was not under any restraint to the knowledge, information or belief of this deponent.  And further these deponents say not.

Sworn to and subscribed this 11th day of March 1891 before me

Currituck County  }    In re Estate of Thomas JARRED, dec'd.
     A paper writing purporting to be the last will and testament of Thomas JARRED, decd., is exhibited for probate by Alma B. MIDGETT, executor therein named; and the due execution thereof by the said Thomas JARRED, decd., duly proven by the oath & examination of B.F. HOSKINS and B.S. WALKER, subscribing witnesses thereto; and it is further shown to the satisfaction of the Court by said witnesses that the said Thomas JARRED was at the time of making said will, of sound mind and memory, of full age to execute a will, and under no restraint to their knowledge information or belief.
    It is thereupon considered, adjudged & decreed that said proof is sufficient and that said paper writing is and contains the last will & testament of Thomas JARRED, decd.  And on motion it is ordered that said will be admitted to probate and recorded in the Book of Wills of Currituck County and as such filed as provided by law in the office of Clerk Superior Court of said county.
    It is further ordered that said Alma B. MIDGETT be allowed to qualify as executor as provided by law and enter upon the discharge of the duties imposed by said trust.  This 11th day of March 1891.

    Thereupon the said Alma B. MIDGETT executor named therein came forward & took the oath prescribed by law & secured letters testamentary with will annexed from? me.

EXECUTOR'S OATH

  North Carolina  }        SS. In the Probate Court
Currituck County }
    I, A.B. MIDGETT, do solemnly swear (or affirm) that I believe this paper writing to be and contain the last will and testament of Thomas JARRED deceased; and that I will well and truly execute the same by first paying his debts and then his legacies, so far as the said estate shall extend, or the law will charge me, and that I will well and faithfully execute the office of an executrix agreeable to the trust and confidence reposed in me, and according to law, so help me God.
