James Jarard, Sr.

In the name of God Amen, I James JARARD SENR. of the county of Currituck and State of North Carolina being of sound mind and perfect memory do make and ordain this my last will and testament in manner & form as follows that is to say”

   1st I give and bequeath unto my beloved wife Patsey forever one negro woman named Lucy.

  2nd Then I loan to my beloved wife Patsey all of my estate real & personally during her natural life after the death of my wife Patsey I give and bequeath unto my three sons Thomas, Jasper, & James all of my lands that I am now in possession of forever.

   4 I give and bequeath unto my three daughters Abey, Polly & Patsey all of my chattle property in doors and out doors namely all of my stock hogs, cattle, sheep etc. household & kitchen furniture to be sold and equally divided after the death of my beloved wife Patsey among the aforenamed daughters.

   As witness whereof I the said James JARARD do hereto set my hand and seal this December the 20th 1856

Signed sealed published and delivered by the said James JARARD to be his last will and testament in the presents of  us who at his request and in his presents do subscribe our names as witness

Whereof I leave my son Thomas JARARD whole & sole executor

Currituck County Court  - Feby Term 1857
   The foregoing paper writing purporting to be the last will and testament of James JARARD deceased is exhibited in open court by Thomas JARARD, the executor therein named and the due execution thereof by the said James JARARD is proved by the oaths and examination of John BUNNILL SR. & John BUNNILL JR. the subscribing witnesses thereto.  It is therefore considered by the court that the said paper writing and every part thereof is the last will and testament of the said James JARARD and the same is ordered to be recorded & filed, and thereupon the said Thos. JARARD executor as aforesaid duly qualifies as such by taking the oath required by law.
