In the name of God Amen, I Robert HEATH of the County of Currituck and provence of North Carolina being in sound in mind and memory Thanks be to Almighty God for the same, do therefore make and ordain this to be my Last Will and Testament in manner and form as foloeth

First I recomend my soul to the hands of him that give it to me and my body I give to the earth from thence it was taken to be buried in a christian like maner by and at the discretion of my executors hereafter named as for my temporel estate I dispose of as followeth.

Item I give and bequath to my beloved Wife Elisabeth HEATH one fether bed and furniture, two cows and calfs, one mare caled Fly to her and her heirs forever, and allso an note of fifty pounds due from Isles COOPER in Halifax to her and her heirs for ever and all the rest of my property except such legeseys as shall be hereafter mentioned the use of it and all of it within dors and without during her natrel life or widowhood then to be equley divided amongst four younest Daughters Julias, Anne, Frankey and Barbrey and my two youngest Sons Andrew and Arthur C. HEATH and if either of them die without heir of their body lofully begotten to be equally divid amongst the living heirs of the six above mentioned children to them and their heirs for ever.

Item I give to my Daughter Marget BRUNT five shillings to her and her heirs for ever.

Item I give and bequeath to my two beloved Sons Ryland HEATH and Enoch HEATH my land and plantation where I know live on to be divided as folloeth, beginning at the run thence runing along the ditch as fair as the ditch extends thence a strait course as fair as my land extends thence binding on Daniel LEEs line Ryland HEATH to have the part next to Daniel LEE the other to Enoch HEATH to them and their heirs for ever and if either of my two Sons Ryland HEATH or his Brother Enoch HEATH shall die without lawfull heirs of their body lawfuly begotten and if either of the three eldest die without heir to foul to Arther Cooper HEATH and his heirs lawfuly begotten of his body.

Item I do nominate and apint my beloved Wife Elisabeth HEATH executrix and Enoch DAUGE to this my Last Will and Testament whereof I have hereunto set my hand and seal this the 25th day of January 1795.
