In the Name of God, amen the 2th day of Jenury 1749/50.  I Nehemiah HATH Being weak of Body But of Sounding Memory thanks be to almighty God for it I do make Constitute ordain and Declear this my Last will and Testament in manner and form Following revoking and annualling by these presents all and Every Testament and Testaments and Will and Wills hearetofore by me made and decleared Either by word or writing and this to be taken only for my Last will and Testament and None others and first Being penitent and Sorry from Bottom of my hart for my Sins past most humbly desiering forgivenesses for the Same I Give and Commit my Soul unto almighty God my Savour I Chousen and my Body to be Bared [buried] in Such a place where it Shall please My Executor hear after Named to appoint and Now for the Settling of my Temporl Estate and Such Goods Chattels and depts as it hath pleased God for above My desiarts to Bestow upon me I do order Give and disar to Bestow upon me I do ordain Give and despose the Same in manner and form.  I do Desiar that Every person or persons Whatsoever Shall be well and Truly paid With in Convenient time after my deses by My Executors Hear after Named.

Item I Give and Bequeath in Witness Unto Mary CREADEL for Cows Liberty for too Cows and Calfs and three guineas to Run upon the plantation Tell thay plase to take them away.

Item I Give and Bequeath Unto Well Beloved Wife after my Lawfull depts is paid Eliabth HATH after all my Lawfull depts is paid Every thing with with [sic] in doors and without Both Rearl and par____ Indureing of hir Wedowhood and then ye Land to Robt. HATH which I Now Lives upon Like wise I ordain My Well Beloved wife Eleabth HATH My holy and Soly Excutor of this My Last will and Testament afs witness My hand and Seal ye yar first above written.

    These may Certifie that Willis ETHERIDGE, William BLUNT & Lazerus FLOREA Subscribing Evidences to the Within Will appeared in Open Court and made Oath on the Holy Evangelist that they were present and Saw Nehemiah HEATH Sign Seal publish & Declare the within to be & Contain his Last Will and Testament and that the said Nehemiah was then & at that time of Sound & Disposing Memory.  Then also appeared Elizabeth HEATH Executrix in open Court and took the Executors Oath in due form of Law.  Ordered that the Horble Nathaniel RICE Esqr Secretary of the said province have Notice there of and that Letters Testamentory Issue thereon as the Law Directs.
