last will and Testament of Eliza GREGORY Dec’d

State of North Carolina
    Currituck County

   I Eliza GREGORY being of sound and disposing mind & memory do make ordain and declare this to be my last will and testament viz.  It is my will and desire that Margaret GREGORY have the use of my lands & houses and all the appurtenances thereto as long as she lives free of all incumbrance or I loan it to her during her lifetime at her death I give & bequeath the same with all appurtenances to Tempy GREGORY the daughter of Margaret GREGORY in fee simple to have and to hold free of all incumbrance to her and her heirs forever but should she die before she is seized and possessed of it without issue or heir then it is my will that my next nearest of kin shall have it.  It is my will as also by agreement that Margaret GREGORY pay my funeral expences out of her own funds.  It is my will that all the residue of my chattle property hereinafter specified be sold and the proceeds appropriated to paying on debts which I owe and after the paying of my debts should there be a surplus it is my will that Tempy GREGORY my niece should have it.  In witness hereunto I have set my hand & seal this the 14 day of Decr. 1859.

Signed sealed & declared by the said Eliza GREGORY as the last will & testament and signed by her in our presence & we at her request in her presence & in the presence of each other have subscribed our names as witnesses
