Currituck County

In an Inferior Court of Pleas and Quarterly (faded out------) the Court House for the said County on the first Tuesday (faded out) in July 1761. Present His Majestys Justices.

Trueman GARRETT Executor of the Last Will and Testament of James GARRETT late of Currituck County ???? deceased Planter exhibited in open court the said Will praying it might be proved whereupon it was then and there proved by the oaths of Joseph HAMAN and James BURNHAM two of the subcribing witnesses thereto in due form of law and ordered to be requested(?) which accordingly it is and follows in these words, To Wit:

In the name of God Amen the second day of January 1760 I James GARRETT being sick and weak of body but of sound disposing mind and memory thanks be to almighty God for it and calling to remembrance the uncertain estate of this ???????? life that every man must yield unto death when it shall please God to call him I therefore commit my body to the ground and my soul unto the hands of almighty God that gave (torn) and as touching and concerning what worldly estate it pleased the almighty God to bless me with I do hereby this my Last Will and Testament give and bequeath in manner and form following.

I give and bequeath unto my Brother Trueman GARRETTs son John GARRETT one hundred acres of land more or less it being the Plantation tract of land whereon I now live to him and his heirs forever.

I give and bequeathe unto Brother Johns son James GARRETT fifty (torn) of land more or less being that part of my land whereon my Brother Trueman now lives to him and his heirs forever. I also give unto James GARRET on feather bed and furniture two cows and calfs my young mare called Bonny shall bring to him and his heirs forever.

I give and bequeath unto my Brother Trueman GARRETs son John GARRETT all the rest of the estate which I have not already given away within doors and without (torn) my wife deceased to him and his heirs forever and I hereby revoke all wills by me before made and acknowledge this to be my Last Will and testament and I do also nominate and constitute ordain and appoint my beloved (torn) and my Brother Trueman GARRETT my whole and sole Executor to this (torn) will performed. In witness whereof I have set my hand and seal (torn) year above written.
