The defendant enters Caveat to the Paper writing propounded as the last will and Testament of Willis GALLOP decd. Issue to try whether the paper writing propounded be the last will and Testament of Willis GALLOP deceased Executed in due form of law to pass real personal and mixed estate Ivey William COOPER 1. Joshua W. BAXTER 2. Armistead WHITE 3. William WOODHOUSE 4. John JARVIS 5. Leven WHITEHURST 6. Samuel B. JARVIS 7. James OWENS 8. Joseph HUTCHINGS 9. Caleb WILLIAMS 10. James CAROON 11. and Willoughby McBRIDE empannelled and Sworn Say the paper writing is the last will and Testament of Willis GALLOP decd. Executed in due form to pass real personal and mixed estate and it is ordered that said paper writing be and the same is hereby admitted to probate as a will passing real personal and mixed Estate and that the same be recorded when the said Hodges GALLOP and Caleb T. SAWYER Executors thereto appeared in open Court and took the oath required. Ordered that letters testamentory issue.

In the name of God amen, I Willis GALLOP of the State of North Carolina Currituck County, being in Reasonable health and Sound mind and memory thanks be to God for the Same do make and ordain this my last will and Testament in manner and form following to wit–

Item 1 I lend the use of my plantation whereon I now live to my wife Polly GALLOP during her natural life if She choses to live on it Runing up the point to a read(?) hill thence west to the Sound Except one of land where on the wind mill stands and the mill, also lend unto my wife Polly GALLOP the following negroes to wit Negro man old Messick and his son little messick, and woman Isbal, unto my wife Polly GALLOP during her natural life or widowhood I lend the use of half Dozen chairs our bed and furniture, one chest one beaufat and furniture two Pots one dutch oven and tea kittle two Pot Iron trammels two old Tables, all the Spun and spinning Stuff all the pottry all the provisions on hand or enough for her and her family For two months, also three cows and calves and one third part of my hogs her choice one pair of firedogs, one small canoe one hand mill one young mare called fly one bridle and Saddle one loom and harness two narrow axes three hoes one Plow and Gun during her natural life or widowhood.

Item I Give and bequeath unto my Son Hodges GALLOP the following Tracts of land on the North Banks one tract lying East of Nothern Gut known by the MELSON tract one lying East of Jane Guit Creek formaly John GALLOPs deceased also the tract I live on Called Martins Point from the Creek to the Sound up to the Waterfence also my Wind Mill thereon Also the residue of my lands on the North Banks which I do not Give away in this will or by deeds of Gift I also Give unto my son Hodges GALLOP the following tracts of land on Powells Point one tract where Samuel MURRELL lived also one I bought of Hezekiah OWENS also the piece I bought of John DOUGH, adjoining the other, also the tract I bought of James G. HALL also the tract adjoining which I bought of Sidney LAMB, also the Residue of my lands that I own on Powells Point which I do not Give away in this will or by deeds of Gift. I also Give my son Hodges GALLOP the following negroes to wit old Mesick and his son little Mesick, woman Isbal after my wifes death or marriage I also unto son Hodges GALLOP girl Matilda and child Barsheba, man Mustapher, Boy Obed, Girl Sally, Mary child of Vina, Lydia and child Polly, Dick and Solomon, George, Malachi, Jack, Aaron, and James. I also Give unto my son Hodges GALLOP all my money or notes that he may have in his possession at my death also all the house hold furniture that belongs to at his house on Powells Point I also Give Unto my Son Hodges GALLOP the Schooner High Priest and her materals I also Give my son Hodges GALLOP Iron chest to him and his heirs forever.

Item I Give and bequeath unto my Daughter Bretainia BEAN one tract of land on Powells Point which I bought of Daniel DOUDY also a nother tract adjoining which I bought of Luke GREGORY also one on the North Banks beginning at Thomas HARRIS’ line runing South far as will include one hundred acres of land. I also Give unto my daughter Bretainia BEAN the followin negroes to wit woman Betsy her two children City and Eliza. I also Give my daughter Bretainia BEAN five hundred dollars in money or notes if as much on hand at my death to her and her heirs forever.

Item I give and bequeath unto my daughter Mavey D. DOUDY one tract of land on the North Banks which I bought of Spence HALL whereon Jno. PATERIDGE decd formaly lived also one piece I bought of Benjamin DOUGH I also Give unto my daughter Mavey D. DOUDY the following negroes to wit negro Thomas, Girl Rose, Girl Nancy, and woman Sally and one Cow and Calf and bed and furniture also five hundred dollars in money or notes if as much on hand at my death to her and her heirs forever.

Item I Give and bequeath unto my daughter Golden PATERIDGE one tract of land on Powells Point which I bought of Malachi CORBLE whereon she now lives. I also Give unto my daughter Golden PATERIDGE the following negroes to wit negro boy David and Girl Rachel also five hundred dollars in money or notes if as much on hand at my death to her and her heirs forever.

Item I Give and bequeath unto my Legitimate son Zadock GALLOP a tract of land on Powells Point known by the MORRES tract adjoining Abel OWENS deceased lands, also a piece I bought of Solomon ASHBEE adjoining the Same also one Bed and furniture one Cow and Calf also two hundred and fifty dollars in money or notes if as much on hand at my death to him and his heirs forever.

Item I Give and bequeath unto Kimley RODGERS a piece or parcel of land on the North Banks containing Seventy five acres lying on the North Side of the lands formaly belonging to Jasper GREEN whereon his mother now lives also negro Girl Milley and boy Miles one bed and furniture in the possession of his Mother, also all the Stock in his mark or in the possession of his mother also one mare colt named little Gin, also two hundred and fifty dollars in money or notes if as much on hand at my death to him and his heirs for ever.

Item I Give and bequeath unto Iredel RODGERS Seventy five acres of land Situated on the North Banks lying to the north and adjoining Kimley RODGERS, runing from the Creek to the Sea also one negro Girl Hanner(?) and boy Washington one bed and furniture all the hogs or Cattle in the following mark namely Swallowfork the left Ear Crop and under Keel the right Ear also two hundred and fifty dollars in money or notes if as much on hand at my death to him and his heirs.

Item I Give and Bequeath unto Willis P. RODGERS Seventy five acrs of land on the North Banks lying North and adjoining Iredels runing from the creek to the sea also one negro boy named Caleb and Girl Vilot one bed and furniture one Cow and Calf also two hundred and fifty dollars in money or notes if as much on hand at my death also one mare called old Gin and my Short two Barrel Gun to him and his heirs forever.

Item I Give and bequeath Unto my Son Hodges GALLOP all the residue of my money and notes not given away in this will that is on hand at my death to him and his heirs forever.

Item My will and desire is that all my chattle Property that is not Given away in this will to be sold and after paying all my Just debts and Expenses the residue of said sail to be equally divided togeather with the book accounts amongst names to wit Hodges GALLOP, Bretainia BEAN, Mavey D. DOUDY, Golden PATERIDGE, Zadock GALLOP, Kimley RODGERS, Iredel RODGERS, and Willis P. RODGERS if all living at the time if not, amongst the living ones.

Item My will and desire is that the chattle property lent to my wife at her death or marriage be Sold at Public Sale and the proceeds arising therefrom be equally divided amongst the above mentioned names and in the above manner.

Lastly I nominate and appoint my Son Hodges GALLOP and Caleb T. SAWYER my whole and Sole Executors to this my last will and Testament Ratifying and confirming this to be my last will and Testament and no other Given under my hand and Seal this the Twelvth day of November in the year of one thousand eight hundred and forty-four.

Signed Sealed and pronounced and delivered by the Testator to be his last will and Testament
