I Susan GALLOP of the afore said County and State being of sound mind but considering the uncertainty of my earthley existencey do make and declare this to be my last will and testam.

First. My executor hereing after name shall give my bodey a decent burial suitable to the wishes my Friends and relatives and pay all Fureal Exspences togeather with all of my just debts out of the first moneys which may come in to the hands belonging to my estate.

Second. I give and devise to my beloved husband Johnathan GALLOP as long as he lives all of my property consistin of all my realestate on both sides of the public roade leading from Parkers Creek to Poplar Branch and all of my money bank accounts bonds and Notes of every kind and all of my chattle property of every kind and all household and kitchen furniture of every kind and at my beloved husband death I give to my Nease Ada W. PARKER all of my property realestate property and chattle property and bank accounts and bonds & Notes and money and all household and Kitchen furniture of every kind.

Third, I hereby constitute and appoint my trustey friend J.W. FORBES my lawful executor to all intents and purposes to execute this my last Will and Testament according to the true intent and meaning of the same and every part and clause thereby revoking and declareing utterly voide all other wills and testaments by me here to fore made in witness where of I the said Susan GALLOP do hereunto set my hand and seal this 31 day of Dec. 1921.

Sign sealed published and declared by the said SUSAN GALLOP to be her last Will and testament in the presence of us who at her request and in the presence and in the presence of each other do subscribe our names as witnss.

PROBATE OF WILL UPON EXAMINATION OF SUBSCRIBING WITNESSES

Currituck County}    In the Matter of the Will of Susan GALLOP, Deceased
   
The paper writing hereto attached and purporting to be the last will and testament of Susan GALLOP, deceased, is exhibited before the undersigned clerk of the Superior Court of Currituck County, North Carolina, by J.W. FORBES, the executor therein named, and thereupon the following proof thereof is taken by the oath and examination of D.W. LINDSEY and Z.G. FORBES, the subscribing witnesses thereto, as follows:
    D.W. LINDSEY and Z.G. FORBES being duly sworn, depose and say, and each for himself deposes and says, that he is a subscribing witness to the said paper writing now shown him, purporting to be the last will and testament of Susan GALLOP, and the they saw her execute (or heard acknowledge the execution of ) this writing as her last will and testament, and that affiant attested it in the presence and at the request of said Susan GALLOP, deceased; and that at the time of its execution (or at the time its execution was acknowledged) said Susan GALLOP was, in affiant’s opinion, of sound mind and disposing memory.

Severally subscribed and sworn to before me, this 9th day of January, 1922.

And thereupon it is considered and adjudged by the Court that the said paper writing and every part thereof is the last will and testament of Susan GALLOP, deceased, and it is ordered that the same, with the foregoing examination and this certificate, be recorded and filed.  This 9th day of January, 1922.

APPLICATION FOR LETTERS TESTAMENTARY

Currituck County:  In the Superior Court Before B.B. BELL, Clerk Superior Court - In the Matter of the Will of Susan GALLOP
    J.W. FORBES
being duly sworn, doth say: That Susan GALLOP, late of said County, is dead, having first made and published her last Will and Testament: and that J.W. FORBES is the executor named therein.
    Further, that the property of the said Susan GALLOP consisting of Real and personal property is worth about $1250, as far as can be ascertained at the date of this application; and that J.L. GALLOP and Ada W. PARKER are the parties entitled under said will to the said property.

EXECUTOR'S OATH

    I,
J.W. FORBES do solemnly swear that I believe this paper writing to be and contain the last will and Testament of Susan GALLOP that I will well and truly execute the same by first paying her debts and then her legacies, so far as the said estate shall extend, or the law will charge me, and all other duties pertaining to the office of Executor I will discharge according to law, to the best of my skill and ability. So help me God.

LETTERS TESTAMENTARY

       Currituck County  }    In Superior Court
State of North Carolina}
To all Whom these Presents shall come --- GREETING:
    It being satisfactorily proven to the undersigned,
Clerk of the Superior Court for Currituck County, that Susan GALLOP late of said county, is dead, having made her last Will and Testament, which has been admitted to Probate (a true copy whereof is hereunto annexed,) and J.W. FORBES the Executor therein named, having qualified as such according to law:
   Now these are therefore to empower the said Executor to enter in and upon all and singular the goods and chattels, rights and credits of the said deceased, and the same to take into possession, wheresoever to be found, and all the just debts of the said deceased to pay and satisfy, and the residue of said estate to distribute according to the directions of said Will.
    Witness my hand and the seal of said Court this the 9th day of January 1922.
