The Last Will and Testament of John FISHER SENR. dec'd. was Exhibited in open court at February Term 1832 and proven by the oaths of Cartwright BELL & Leml. W. McLANING witnesses thereto the Executor therein named Qualifyed and ordered  to be Recorded.

In the name of God amen. I John FISHER SEN. of the County of Currituck and State of North Carolina in a sound mind and memory and in good health blessed be God do this Fourteenth day of may in the year of our lord one thousand Eight hundred and twenty seven make and constitute and publish this my last will and testament in manner following viz.

   First I resign my soul to almighty God who gave it and my body to be buried in a christian like manner in the burying Ground in my old plantation & my Will and desire that said burying Ground should be kept as a family burying ground & be considered not the property of any one individual and that any part of my property hereafter given away shall be subject for the tax if any demanded.

   Item I leve the use of all my goods and chattels rights & credits lands and tenements belonging at this time to me to my wife Lydia during her widdowhood or life.

   Item I give and bequeath to my son John my daughter Roseman and my daughter Polly all that lands & tenements that I purchased of Josep SIMMONS bounded by the lands of Joshua TAYLOR Holowell FISHERs heirs & my old plantation to be divided by lines running from the main road to the water share and share alike the north lot to daughter Polly the middle share to my son John and the third lot to my daughter Roseman after the marriage or death of my wife Lydia to them & their heirs forever.

   Item I give and bequeath to my daughter Peggy three and half acres of land to be laid of out of my old plantation & woods on the north side to run across my old plantation tract parallel with the SIMMONS tract line after the marriage or death of my wife Lydia to her & her heirs forever.

   Item I give and bequeath to my daughter Rebacca three acres of Land to be laid of out of my old plantation tract in the same manner as Peggy after the marriage or death of my wife Lydia to her & her heirs forever.

   Item I give and bequeath to my daughter Sally three acres of land to be laid out of the old plantation tract adjoining my Daughter Rebacca & in the same manner after after the marriage or death of my wife Lydia to her & her heirs forever.

   Item I give and bequeath to my daughter Nancy three acres of land to be laid of out of the old plantation tract adjoining my daughter Sally and in the same manner after the marriage or death of my wife Lydia to her & her heirs forever.

   Item I give and bequeath to my son Maxamillan FISHER one dollar to him and his heirs forever.

   Item I give and bequeath to the heirs of my son Holowell one dollar to them and their heirs forever.

   Item I give to my daughter Polly Fifty dollars in cash to be paid after the marriage of death of my wife Lydia to her & her heirs forever.

   Item I give and bequeath to my son John my daughter Roseman & my daughter Polly all the remainder of my lands & tenements good, & chattels rights & credits not heretofore given away to be equally divided between them share & share alike after the marriage or death of my wife Lydia to them & their heirs forever.

   Lastly I do hereby nominate constitute and appoint my beloved wife Lydia and my son John executrix & executor of this my last will and testament set my hand and seal the day & year above.

Signed sealed published and declared by the said John FISHER Sen. the testator as his last will and testament in the presents of us who was present at the time of signing & sealing thereof
