In the name of God Amen, the twenty second day of January seventeen hundred and eighty nine, I James FEREBEE of the County of Currituck and State of North Carolina -------(faded) weak in body but of sound and perfect mind and memory and calling to mind the uncertainty of (faded) and knowing that it is appointed for all men once to die, do make ordain constitute and appoint this to be my Last Will and Testament in manner and form following Viz.

I will my soul to Almighty God who gave it and my body to be decentlly buried at the discretion of my friends and executors, and as touching my worldly estate wherewith it hath pleased God bless me with in this life, I will devise bequeath and dispose of in manner and form following.

Imprimes: I give to my well beloved Wife Sarah three feather beds and furniture, one mare called Flant, one set of silver tea spoons to her and her heirs forever. And the remainder part of all my moveable estate it is my will it should be sold to pay my lawfull debts and if any should remain I give it to my Wife and heirs &c.

Item: I give to my Brother Robt. FEREBEE that part of my plantation adjoining to Widow STANLEYs begining at a cypress tree at the Shingle Landing thence running along the branch to the gap, thence with a straight line to a marked holly corner tree adjoining Robt. FEREBEE own land provided my Wife should have no lawfull issue of my body begotten then to fall to it and its heirs and assigns forever.

Item: I give to my Brother Thomas FEREBEE all the remaining part of my lands and tenements and the old part of my dwelling house to him and his heirs and assigns forever provided my Wife should have no lawfull issue of my body begotten then &c.

Item: I give to my Brother Thomas a bay colt of the horse Kind.

Item: I give to my Wife Sarah over and above what I gave her the new end of my dwelling house and the kitchen,

Lastly I constitute ordain and appoint my well beloved Wife Sarah FEREBEE, my Brother Thomas FEREBEE and Joseph BALLENTINE to be my whole and sole executors of this my Last Will and Testament and to do ??????? as tho I was personally present, ratifying allowing and confirming this and no other to be my Last Will and Testament revoking, disannulling and making void all other former wills and legacies by me heretofore made Witness my hand and seal the day of the date and year first written.
