Henry Evans

Currituck Co. Will Book 3

In the name of God Amen I Henry EVANS of Currituck County and the State of North Carolina being weak in body but sound in mind and in my perfect senses calling to mind that it is appointed for all men to die do make and establish this my last will and testament in manner as follows first I give and bequeath unto my son Jesse EVANS my young horse to him and his heirs forever.

2nd Item    I lend unto my wife Edney EVANS all of my property land or what some ever of every kind without doors and within during of her natural life or widowhood.

3rd Item    I give and bequeath unto my son Jesse EVANS my mare after my wifes death or marriage unto him & his heirs forever. Now if my mare should bring the fold she is with that she is now with fold it is my will and desire that my son Jesse EVANS should take his choice of the two and the other I give to my son James EVANS and his heirs forever.

Item 4    I give and bequeath unto my son Jesse EVANS six winsor chairs after my wife death or marriage unto him and his heirs forever.

Item 5     It is my will & desire that the bed and bed stead that was given to my son Jesse by his grandfather that he shall take it in possession immediately after my death.

Item 6th     It is my will & desire that the heifer that my father gave to my daughter Sally that she should take it in possession immediately after my death.

Item 7    I give & bequeath to my son James EVANS one feather bed and one iron pot I lent to him when he was married to him and his heirs forever.

Item 8th    I give unto my daughter Sally one feather bed stead & furniture say the bed she lay in.

Item 9     I give unto my daughter Milly EVANS one feather bed stead & furniture & furniture the bed I and my wife sleep on one yearlin heifer white & red colour and loom the big chest & my old linen wheel to her and her heirs forever.

Item 10th    I give & bequeath unto my daughter Ann EVANS one Linnen wheel that she has already in possession to her & her heirs forever.

Item    I give also unto my daughter Sally my new linen wheel to her & her heirs forever.

Item 11th    I give & bequeath unto my two sons James & Jesse EVANS my land whereon I now live to be one equal division in the cleared land for James to have the western ends and Jesse the eastward end with the dwelling house and as to wood land swamp & marsh it is my will & desire it should be divided eastwardly & westerly and my son James to have the north side of my wood land.

Item 12th    it is my will & desire that all the property I have not already given away at the death or marriage of my wife it should be sold & pay my debts and the remainder to be one equal division between my three daughters say Ann OWENS, Sally EVANS, and Milly EVANS after all I nominate appoint my wife Edney EVANS executrix to this my last will & testament this 13th day of February 1830.
