Note: This Will has holes in several places I will put "-----" where it is torn and try to fill in as much as possible.

In the name of God Amen, I Jacob DAWDAY of the State of North Carolina and County of Currituck being sick and weak in body but of sound mind and memory thanks be to God for the same calling to mind the mortality of my body and knowing that it is appointed for all men once to die do make and ordain this my Last Will and Testament that is to say

First of all I recommend my soul into the hands of Almighty God that gave it me and my body to be burried in a decent and christain like manner and as touching such worldly estate it hath pleased God to bless me with I give and dispose of in the following manner wit-----

Item: I lend the use of the lands plantation and houses where I now live unto my Wife Sophia DAWDAY during her natural life if she keeps my children together and endevours to raise and support them in the same but if not for her to have only one third part .

Item: I give and bequeath unto my two Sons Josiah DOWDAY and Jacob DAWDAY the lands and plantation whereon I now live after my Wifes decease if she supports and raises my children on it if she does not and has not but a third part then to have the ------------------------ her decease--- them and their heirs fever(sic)

Item: ------------------------------------- on the banks to be sold by my executor ---------------month credit and the money to be applied to pay ------

Item: I give and bequeath unto my Wife Sophia DAWDAY one feather bed and furniture her choice to her and her heirs forever.

Item: My will and desire is that my Wife Sophia DAWDAY have the use of all the remainder part of my ----------------------to support and raise my children on until the youngest comes to the age of twenty one years provided she keeps and raises my children on it if not the said moveable estate to be equally divided between my Wife Sophia DAWDAY and all my children at any time when she fails to be at the division on judgement of my executor or when my youngest child comes of age to then be equally divided amongst them what shall remain

Item: I give and bequeath unto my two Sons Josiah DAWDAY and Jacob DAWDAY my land on the sand banks to them and their heirs for ever

Lastly I do hereby appoint Thomas POYNER my executor of this my Last Will and testament ratifying and confirming this to be my Last Will and Testament in witness whereof I have hereunto set my hand and seal this 15 day of Febuary 1808.

Note: There is no probate date nor a Clerks name. Date of probate is from Currituck County Court of Pleas and Quarter Sessions minutes. In court minutes, surname is "Dowdy."
