In the name of God, Amen. I Moses CAPTS of the State of N. Carolina and County of Currituck, being in health and perfect mind and memory, thanks be to God for the same, do make and ordain this instrument of writing to be my Last Will and Testament, First I recommend my soul to him that gave it and my body to be buried in a christian like burial and as touching my worldy affairs. I give and bequeath following viz.

Item. My will and desire is that my floating property be sold after my decease.

Item. After my just debts being paid, I lend my beloved Wife Cyntha CAPTS the hole of my estate within doors and without during her widowhood, except what I may otherwise bequeath provided she doth not extraviantly sell use or make way with more of estate then is sufficient to raise my children and maintain her self as to keep them from want, so also she gives my children learning as my estate will afford, and after my Wife Cyntha CAPTS intermarriage, I give my estate as hereafter mentioned.

Item. I give and bequeath after my Wife Cyntha CAPTS deceased the lands that I now live on to be equally divided between my two Sons William and Moses CAPTS to them and their heirs forever.

Item. I give and bequeath after my Wife Cyntha CAPTS dec'd the hole of my personable estate to be equally divided between all my Daughters childred to them and their forever.

Item. I leave and appoint my trusty friend Caleb TATUM and Isaac BAXTER my hole and sole executor of this my last Will land Testament. In witness I have hereunto set my hand and seal this the tenth day of June, one thousand eight hundred and eleven.

Recorded and examined the 22 day of June 1815

I Moses CAPTS, being weak in body, but of sound mind, do hereby give unto my youngest Son Dennison CAPPS his heirs and assigns my negro boy Henry, nothing in this instrument shall be so construed as to destroy any part of my former Last Will and Testament, but simply to give the said negro boy as aforesaid. In testimony whereof I have hereunto set my hand and seal this thirty first day of October in the year of our Lord one thousand eight hundred and fourteen.
