The last will and Testament of Elizabeth CAPPS dec’d. was exhibited in open court at February term 1841 and p[r]oved by testimony of Caleb DUDLEY one of the subscribing evidences there to in due form of law and ordered recorded.

   In the name of God amen, the Seventh day of April in the year of our Lord one thousand eight Hundred and forty. I Elizabeth CAPPS of the State of North Carolina Currituck County being sick and weak in body but of a perfect sound mind and memory thanks be to all mighty God for it have a mind to make this my last will and Testament in manner and form following. First I give my soal to God who and my body to be buried at the discretion of my executor and worldly goods in manner and form following.

   Item I give unto my Son Nuton CAPPS one teaster bed and furniture to him and his heirs forever, also one half dozen stool chairs and half dozen flag chairs to him and his heirs forever, also I give my Son Nuton CAPPS one table I also give my mare and cart to my Son Nuton I also give my Son Nuton my crop that is now intendance to him and his heirs forever.

   Item I give and bequeath unto my Daughter Elizabeth HUMPHERS one cow and yearling to her and her heirs for ever also one ewe and lamb.

   I give unto my Son Caleb CAPPS one ewe and lamb to him and his heirs for ever.

   Item I give unto my Son Joel CAPPS all the balance of my sheep to him and his heirs for ever. Also I give my Son Joel one pair of chair wheels.

   Item I give my crockery ware to my Son Nuton CAPPS and Elizabeth HUMPHERS to be equally divided between to them and their heirs for ever.

   Item I give unto my Son Nuton CAPPS one negro man named Frank to him and his heirs for ever, and I leave all the remainder of my estate of what kind soever to be sold my executor and the money arising there from to be equally divided betwen my thee children namely Caleb CAPPS, Joel CAPPS and Elizabeth HUMPHERS.

   Lastly I nominate constitute and appoint my Son Nuton CAPPS my whole & soal executor to this my Last Will and Testament and I do hereby disannul and revoke all other former wills by me made and acknowledged this and no other to be my Last Will and Testament the day and year above written.
