Eliza Capps
March 25, 1882 - May 1, 1882
[Executor's Oath and Probate of will was found in the estate records]

In the name of god amen.  I Eliza CAPPS of the County of Currituck and State of North Carolina being sick of body and week but of sound mind memory and understanding praise be God for the same do make this my last will and testament in manner and form following.

Item 1st  I give to my daughter Eliza A. SCOTT my land being Eleven acres.

Item 2  After my deced I give the balance of my property to Eliza A. SCOTT.

And I do nominate constitute and appoint Thomas B. SCOTT sole executrix [sic] of this my last will and testament hereby revoking and making void all and every other will or wills at any time heretofore made by me and do declare this to be my last will in testament.  In witness whereof I the said Eliza CAPPS have hereunto set my hand this the 25th day of March 1882.

EXECUTOR'S OATH

State of North Carolina}
     Currituck County    }
I, Thos. B. SCOTT, do solemnly swear that I believe this paper writing to be and contain the last will and testament of Eliza CAPPS and that I will well and truly execute the same by first paying his debts and then his legacies so far as the said estate shall extend, or the law will charge me, and all other duties pertaining to the office of Executor I will discharge according to law, to the best of my skill and ability.  So help me God.

PROBATE OF WILL

Currituck County:  In the Probate Court

A paper writing purporting to be the last will and testament of Eliza CAPPS is offered for probate and the execution thereof proved by the oath and examination of Cornelius JONES & Henry WHITE, the subscribing witnesses thereto, and it appearing that said Eliza CAPPS was of full age, of sound mind and disposing memory and under no restraint or undue influence.  Therefore it is ordered, adjudged and decreed that the said paper writing be and is hereby declared to be the last will and testament of the said Eliza CAPPS.  Ordered to be recorded and filed.  Thereupon the said Thos. B. SCOTT qualified as executor according to law.  This May 1st 1882.
