I, Caleb BALANCE of the aforesaid County and State, being of sound mind, do make and declare this my last will and testament.

1st. I give and devise to my daughter Lizzie SAUNDERS, one third of the tract of land on which I now reside, being the one third part, on the south side of my farm, situate on Bell’s Island, said County and State, in fee simple.

2nd. I give and devise to my daughter Lydia A. MORRISETT, one third part of said tract of land, mentioned in item one being the one third part on the north side of said farm, with all buildings in fee simple.

3rd. I give and devise to my daughter Laura L. GRIGGS, one third part of the farm mentioned in item one, being one third part in the middle of said farm, in fee simple.

4th. I give and bequeath to my said daughter, Lydia A. MORRISETT, all my household and kitchen furniture, also such personal property as may be found in the out buildings, except my horse and buggy.

5th. I give and bequeath to my said daughters, Lizzie SAUNDERS, Lydia A. MORRISETT and Laura L. GRIGGS all my personal property, except such personal property given to my daughter Lydia A. MORRISETT mentioned in item four, consisting of money, notes, and all personal property of every kind, not heretofore bequeathed, to be equally divided among them.

I hereby constitute and appoint my three daughters, Lizzie SAUNDERS, Lydia A. MORRISETT and Laura L. GRIGGS my lawful executrixes to all intents and purposes, to execute this my last will and testament according to the true intent and meaning of the same, and to pay all funeral expenses together with all my just debts out of my estate.

In witness whereof I, the said Caleb BALLANCE, do hereunto set my hand and seal, this 15th day of June 1921.

Signed, sealed, published and declared by the said Caleb BALLANCE, to be his last will and testament in our presence; and we, in his presence have, at his request, hereto subscribed our names as witnesses.

LETTERS TESTAMENTARY

State of North Carolina}
   
To all Whom these Presents shall come—GREETING:  It being satisfactorily proven to the undersigned, Clerk of the Superior Court for Currituck County, that Caleb BALLANCE late of said County, is dead, having made his last Will and Testament, which has been admitted to Probate (a true copy whereof is hereunto annexed,) and Mrs. Lydia A. MORRISETT & Mrs. Laura L. GRIGGS the executrixes therein named, having qualified as such according to law.
    Now these are therefore to empower the said Executrixes to enter in and upon all and singular the goods and chattels, rights and credits of the said deceased, and the same to take into possession, wheresoever to be found, and all the just debts of the said deceased to Pay and satisfy, and the residue of said estate to distribute according to the directions of said Will.

PROBATE OF WILL UPON EXAMINATION OF WITNESSES

Currituck County }  In the Superior Court—Before the Clerk.
    In the matter of the Will of Caleb BALLANCE deceased, is exhibited before the undersigned Clerk of the Superior Court of Currituck County, North Carolina, by Mrs. Lydia A. MORRISETT & Mrs. Laura L. GRIGGS, the executrix therein named, and thereupon the following proof thereof is taken by the oath and examination of P.L. HAMPTON and Leon DOXEY, the subscribing witnesses thereto, as follows:
    P.L. HAMPTON and Leon DOXEY being duly sworn, depose and say, and each for himself deposes and says, that he is a subscribing witness to the said paper-writing now shown him purporting to be the last will and testament of Caleb BALLANCE, and that he saw him execute (or heard acknowledge the execution of) this writing his last will and testament, and that affiant attested it in the presence and at the request of said Caleb BALLANCE , deceased: and that at the time of its execution (or at the time its execution was acknowledged) said Caleb BALLANCE was, in affiant’s opinion, of sound mind and disposing memory.

Severally subscribed and sworn to before, me this 19th day of June 1926.

   And thereupon it is considered and adjudged by the Court that the said paper-writing and every part thereof is the last will and testament of Caleb BALLANCE, deceased, and it is ordered that the same, with the foregoing examination and this certificate, be recorded and filed.  This 19th day of June, 1926.
