Currituck County Estates

John F. Burfoot - 1872

not dated - Petition for Dower.  Margaret BURFOOT, widow of John F. BURFOOT, states that her late husband died intestate and that he was seized of a tract of land containing about 366 acres in Currituck County adjoining P.H. MORGAN on the west, Saml. FEREBEE & the heirs of T.L. DOZIER on the north, H.M. SHAW and others on the east and Margaret D. BAXTER on the south; that her husband left surviving him Sarah Jane BARNARD of full age, and Adelia and Dennis BURFOOT who are under the age of 21.  She asks the court to appoint commissioners to set off to her 1/3 dower and to have a guardian ad litem appointed for her minor children.  /s/ B.M. BAXTER, Atty.

not dated - B.M. BAXTER was appointed guardian ad litem

not dated - Commissioners appointed to set off 1/3 part of the land mentioned in petition.  /s/ A.O. DEY, CSC

Winter Term 1873 - Commissioners Report for Partition of Land.  The partition of land between W.D. BARNARD and wife Sarah Jane, Dennis BURFOOT and Adelia BURFOOT, tenants in common of the lands descended to them as children and heirs at law of John F. BURFOOT, deceased, was divided.  [Metes & bounds were given on all parcels of land but acreage was not given and although it said the plats were included they were not found in the folder.]
Lot #1 to W.D. BARNARD and wife Sarah Jane beginning at Samuel FEREBEEs corner at Juniper Ridge
Lot #2 to Dennis BURFOOT, upon which is the widow's dower
Lot #3 to Adelia BURFOOT which consists of 4 separate parcels [last parcel consisted of 30 acres]
/s/ James C. [unreadable], Jos. B. MORGAN, Spence GREGORY, B.C. BELL, Commissioners

[There were at least two more documents in the folder dated April 1872 & Winter Term 1873 which pertained to a petition for division between W.C. Mercer & wife Ann against William Cox, B.B. Cox and James Cox but they seemed to be misfiled in the John F. Burfoot folder so I did not include them.]

NOTE: According to cemetery records John Burfoot was born in 1814 and died in 1868.  His wife, Margaret, was born in 1820 and died in 1901.  They are both buried on the old Burfoot farm in Shawboro, N.C.
