not dated - Petition for Guardian ad litem - Ann M. BALLANCE, Nancy W. PARKER, Jno. JARVIS & wife Mariam, and C.H. SANDERS state that they are tenants in common of a tract of land in Currituck County joining the lands of N.N. HAMPTON, John HAMPTON and others and are the heirs of Mary? J. BALLANCE, decd who are minors without guardian.  They petition the Court to appoint a guardian and ask that commissioners divide the same into 5 equal shares.  /s/ W.B. 5 Aug 1878 - Summons to the Sheriff of Currituck County for Clara, Clayton, Claretta, James, Florence, Henry, Charles, Medora & Mary J. BALLANCE to appear in Superior Court on the 1st Monday in Sept. 1878 to answer a complaint.  /s/ A.O. DEY

5 Aug 1878 - Appointment of Guardian ad litem.  Ann M. BALLANCE, et al. vs Clara, Clayton, Henry, Charles, Medora, Claretta, James, Florence and Mary Jane BALLANCEAnn BALLANCE requests the Court to appoint a suitable person as guardian, ad litem.

5 Sept 1878 - Appointment of Guardian, at litem.  The Court orders that John BALLANCE Armstead WHITE be appointed as guardian of the infant defendants Clara, Claton, Charles, Henry, Medora, Claretta, James, Florence & Mary Jane BALLANCE and defend the same on their behalf.  /s/ H.B. ANSELL, CSC

24 Oct 1878 - Commissioners Report [extremely dim and hard to read]- Commissioners make a partition between and among Mariam JARVIS, Jane BALLANCEs children, Clara, Claton, Henry, Charles, Medora, Claretta, James, Florence, and Mary Jane BALLANCE, Cyntha H. SAUNDERSON, Nancy W. PARKER and Ann M. BALLANCE, tenants in common of the lands descended to them as children and heirs-at-law of Wilson BALLANCE, deceased.

Plat No 1 - Located on Churches Island
Lot #1 - Appropriated to Jane BALLANCEs children above named.  Land begins at Corbal TAYLORs line on the Sound and joins the Marsh, containing 71/2 acres exclusive of the burying ground which is 1/4 acre and to be held in common by all the heirs.
Lot #2- Appropriated to Nancy W. PARKER.  Land begins on the Sound at Lot #1 and joins the Marsh containing 71/2 acres.
Lot #3 - Appropriated to Mariam JARVIS.  Land begins on the Sound at Lot #2 and joins the Marsh containing 71/2 acres.
Lot #4- Appropriated to Ann M. BALLANCE.  Land begins on the Sound at Lot #3 and joins the Marsh containing 71/2 acres with all the buildings on the farm.
Lot #5 - Appropriated to Cyntha H. SANDERSON.  Land begins on the Sound at Lot #4 and joins J.T. HAMPTONs line and the Marsh containing 5 acres.

Plat No 2 - Located at Piney Island
Lot #1 - Appropriated to Ann M. BALLANCE.  Land begins at a stake in Mager MERCERs line and joins Benj. WALKERs line and the marsh containing 21/3 acres and both lots being valued at $146.25.
Lot #2 - Appropriated to Miriam JARVIS.  Land beginning at a stake in Mager MERCERs line in Lot #1 and joining Benj. WALKERs line containing 3 acres and both lots being valued at $146.25.
Lot #3 - Appropriated to Cyntha H. SANDERSON.  Beginning at a stake in Mager MERCERs line in Lot #2 and joining Benj. WALKERs line containing 2 acres and both lots being valued at $171.25.
Lot # 4 - Appropriated to Nancy W. PARKER.  Beginning at a stake in Mager MERCERs line in Lot #3 and joining Sanford DUNTONs line and Benj. WALKERs line containing 2 acres and both lots being valued at $146.25.
Lot #5 - Appropriated to Jane BALLANCEs children as aforesaid.  Beginning at a stake in Mager MERCERs line in Lot #4 and joining Sanford DUNTONs line containing 2 acres and both lots being valued at $146.25.

Lots #5 & #3 appropriated to Cyntha H. SANDERSON is to pay $5 to each of the other heirs.

25 Nov 1878 - Notice of Commissioners Report - Ann M. BALLANCE, Nancy W. PARKER, Jno. JARVIS and wife Mariam and C.H. SANDERSON vs. Clara, Claton, Claretta, James, Florence, Henry, Charles, Medora, and M.J. BALLANCE, by their guardian Ad Litem, A.S. WHITE.  If any of the above parties have cause to show why said report should not be confirmed, they may file their exceptions within 10 days from the service of this notice or a motion will be in order for its confirmation.  /s/ H.B.
